REFERRING to your circular despatch, dated 16th October, 1902,* forwarding to the Officers Administering the Governments of the States of Australia a copy of correspondence with the Foreign Office respecting the position in Australia of Asiatics, and in particular of Japanese, I now have the honour, at the instance of Prime Minister, to invite your attention to the existing Commonwealth Laws,

my which deal more or less directly with Asiatics, for instance:-

The Post and Telegraph Act, 1901, Section 16; and

The Commonwealth Franchise Act, 1902, Section 4.

2. With respect to the various State Acts regulating the admission of persons to Australia, I have the honour to state that the Immigration Restriction Act of the Commonwealth is administered in priority to the Acts of any of the States of Australia.

3. The provisions of Section 92 of the Constitution relating to the free inter- course among the States may also be considered as of importance.

I HAVE the honour to acknowledge the receipt of your despatch, No. 42, of the 16th October last,* respecting the position in Australia of Asiatics, and in particular Japanese, and to transmit copies of Acts, &c., as noted in the margin, giving information as to the position in Australia of Asiatics, so far as this State is concerned. In practice, regard- ing memorials for naturalization from Syrians, inquiries are made (independently of the pro- visions of the Aliens Act) as to their character, circumstances, and the likelihood of their per-. manent settlement in Victoria. Japanese are not treated differently from other aliens. The question of dealing specially with Syrian and Indian hawkers has been much discussed, but has not been dealt with by legislation.

I HAVE the honour, with reference to your despatch, Queensland, No. 48,* enclosing copy of correspondence with the Foreign Office, in which information is sought by the French Government respecting Laws or Regulations applicable in Australia, to Immigrants of Asiatic race, particularly Japanese, on arrival, to reply as follows:- A
