SIR,
Government House, Pietermaritzburg, Natal, December 22, 1902. In reply to your despatch, No. 178, of the 14th November,* enquiring what laws and regulations are applicable in Natal to immigrants of Asiatic race, I have the honour to forward copy of memorandum on the subject prepared by the Secretary, Law Department.

Memorandum with reference to Laws and Acts relating to Asiatic immigrants to Natal.
There are no laws applying specifically to Asiatic or Japanese immigrants. I put up a copy of the Immigration Restriction Act (No. 1), 1897,† which would apply to Asiatics and Japanese in the same way as to persons of other nationalities.
I also enclose a copy of Act, No. 8, 1896, "To amend the Law relating to the Franchise," which excludes from the enjoyment of the franchise subjects of those countries which have not hitherto possessed elective representative institutions founded on the Parliamentary Franchise, unless specially exempted by the Governor in Council.
It is probably not necessary to give any detailed information in regard to the Indian Immigration Laws, as these deal only with a class of persons specially introduced by a public department, and do not affect "immigrants" in the ordinary sense of the term. The Laws and Acts are as follows:-

2. In pursuance of your request, I transmit a letter from my Ministers, giving general information on the subject, and covering copies of all Acts of Tasmania bearing on it. You will observe that there has been no special legislation with respect to Japanese.

Premier's Office, Hobart, December 15, 1902. REFERRING to the Right Honourable the Secretary of State's despatch, No. 39, dated the 16th October last, returned herewith, requesting to be furnished with copies of all the Acts and Regulations in force in this State bearing on the subject of the position in Tasmania of Asiatics, and in particular of Japanese, I have the honour to forward herewith a copy of the "Alien Act,"* (25 Vict., No. 2) of this State, which deals with the holding of real and personal property by “aliens,” and with the naturalization of aliens.
Under our Constitution Acts, no person can exercise the franchise unless he is a natural-born or naturalised subject of His Majesty, and no person may be elected a Member of the Legislative Council or House of Assembly of Tasmania unless he is a subject of the King, either natural-born, or for at least five years a naturalised alien.
I also forward herewith copies of "The Chinese Immigration Act, 1887,"* (51 Vict., No. 9), which applied only to Chinese, and not to Japanese, and of "The Immigration Restriction Act,* (62 Vict., No. 69), which was of wider applicability. In my opinion, both these last-mentioned Acts are superseded by "The Immi- gration Restriction Act," No. 17 of 1901, of the Federal Parliament, which now regulates the admission into the Commonwealth of Asiatics and others.
With the exceptions above referred to, I am not aware of any Acts or Regula- tions which define the limits of the position of Asiatics.or Japanese in this State.

Ministers, to inform you that the only Act in force in this State bearing on the subject is the "Chinese Restriction and Regulation Act, 1888,"* a copy of which I enclose here- with.
