Any person who wilfully alters, removes, conceals or damages, A. 345. or attempts to alter, remove, conceal or damage, any signal or mark used for the purposes of navigation, is guilty of telony.

Any person who does any of the foregoing acts negligently is guilty of a simple offence.

294.—Damage to Highways and Bridges.

Any person who wilfully destroys or damages any highway, A. 347 (c). or any bridge over which a highway passes, with intent to B. 393. renler, or so as to render, such highway dangerous or im- passable, is liable to penal servitude for life.

Any person who wilfully causes any such highway or bridge to become dangerous or impassable, or who wilfully does an act likely to cause any such highway or bridge to be destroyed or damaged or rendered impassable, is guilty of a misde- meanour, and also of a simple offence.

295.-Damage to Sea Banks, Dums, &c.

Any person who wilfully breaks, cuts down, damages, A. 347 (6) destroys or removes, any bank of the sea or any inland water (1) (j). or reservoir, or any dam or any floodgate, sluice or work, 396 (c).

B. 393-395, belonging to any port, harbour, dock, reservoir, pond, canal, C. 469, ii., river, or inland water of any kind, or any part thereof, is guilty (1), vi., (4). of a misdemeanour and also. of a simple offence, and if he C. 473. thereby obstructs the navigation of any canal or navigable c. 97, s. 30, river, or acts as aforesaid with intent to cause any inundation, 31, 32. is guilty of felony; and if he thereby causes any actual inun- dation is liable to penal servitude for life.

296.-Damage to Mines and mining Machinery.

Any person who, with intent to damage a mine or obstruct A. 346. the working thereof,

(1) causes water to run into the mine, or any subter- ()-(11), ranean channels communicating therewith; or

(2) damages any shaft or passage of the mine; or

(3) damages with intent to render useless any machi- nery, apparatus, building, bridge, or road belonging to the mine, whether the object damaged be complete or not; or

(4) hinders the working of any such machinery or apparatus; or

(5) damages or unfastens, with intent to render use- less, any rope, chain, or tackle, used in any mine or upon any way or work connected therewith,

is liable to penal servitude for life.

297.—Dumage to Machinery and Goods in Course of

Manufacture.

Any person who wilfully destroys or damages any goods in A. 347 (n) process of manufacture, or any machinery used for agricultural (6). manufacturing or mining purposes, or for the purpose of B. 398. navigation, or any manufacturing implements, with intent to C 169, vi., render them useless, if the value of the things destroyed or the 24 & 25 V.

298.-Damage to Animals.

Any person who wilfully kills, maims, or wounds any horse, ass, cattle, sheep, goat, swine, or dog, or the young thereof, is guilty of felony; and is also guilty of a simple offence,

299.-Damage to Documents.

Any person who wilfully damages any document, the stealing of which is felony, is guilty of felony.

300.—Damage to private Fisheries.

Any person who wilfully breaks, cuts through, damages, destroys, or removes any bank, dam, floodgate, sluice, or work, or any part thereof, belonging to any lake, river, reservoir, c. 97, s. 32. pond, or other water in which there is a right of private fishery, with intent to take or destroy, or so as to cause the destruction of, the fish therein, is guilty of felony, and also of a simple offence; and

any person who wilfully puts into any such water as aforesaid, any noxious material, or who causes any ex- plosion therein, with intent to destroy any fish being, or to be put therein, is guilty of a misdemeanour, and also of a simple offence.

301.--Trees.

Any person who wilfully damages or pulls up any tree, bush, or other vegetable, or any number thereof, growing in any cultivated or enclosed place, is guilty of felony, if the value of the total damage he causes on that occasion exceeds £5; and he is guilty of a misdemeanour, and also of a simple offence if such value exceeds £1; and of a simple offence if such value excels 18.

302.-Damage generally.

Any person who wilfully damages, to the total value on one occasion of five pounds or more, any property, for wilful damage to which no special punishment is by law prescribed, is guilty of a misdemeanour, and also of a simple offence.

Any person who wilfully damages, to the total value on one occasion of more than one shilling and less than five pounds, any such property as aforesaid, is guilty of a simple offence.

303.-Doing Damage after a Previous Conviction.

Any person who is convicted of a misdemeanour under this chapter after having been convicted of a felony, or a misde- meanour, or two simple offences under this chapter, is guilty of a felony.

Any person who is convicted of a simple offence under this chapter, after having been convicted of two simple offences under this chapter, is guilty of a misdemeanour.
