CHAPTER XXX.-FRAUDS BY DEBTORS AND IN BANKRUPTCY.
304-Definition of Bankrupt.
A bankrupt is any person against whom a bankruptcy order has been made (or as the case may be),
305.-Absconding from A.B.
Any person who after or within two months before the A. 351. presentation of a bankruptcy petition against him, with intent B. 410, to defraud his creditors, leaves A.B. and takes with him, or C. 519 makes preparation for leaving A.B. and taking with him any 32 & 33 V. part of his property to the amount of twenty pounds or upwards, which ought by law to be divided amongst his creditors, is guilty of a misdemeanour.
306.-Defrauding Creditors.

Any person who with intent to defraud his creditors or any A. 350. of them-
B. 409. O. 530.
(1) makes any gift, delivery, or transfer of his property 32 & 33 V. or any charge upon his property; or
c. 62, s. 13 (2), (3).
(2) conceals or removes any part of his property after or within two months before, the date of
any unsatisfied
judgment or order for the payment of money obtained against him,
is guilty of a misdemeanour.
307.—Bankrupt concealing Property or Books.
Any person who, with intent to defraud, after or within four months before the presentation of a bankruptcy petition—
(1) conceals, removes, delivers, transfers, or makes charge on any of his property to the value of £10; or
(2) conceals any debt due to or from him; or

308.—Bankrupt refusing Discovery or Delivery of Property.

documents relating to his property, as it is in his power and which he ought by law, to deliver up, and any person who prevents or attempts to prevent any such pro- fluction or delivery,
is guilty of a misdemeanour,
309.—Bankrupt making Omission in his Statement, or allowing false Proof.
Any bankrupt who, with intent to defraud-
(1) makes any material omission in any statement relating to his affairs and made to any trustee adminis- tering his property for the benefit of his creditors or to his creditors collectively; or
(2) knowing or believing that a false debt has been proved by any person under his bankruptcy, fails for-a month to inform the trustee thereof,
is guilty of a misdemeanour.
310.—Bankrupt fraudulently accounting, obtaining Credit, &c.
Any bankrupt who frandently---
(1) attempts, or has within four months before his bankruptcy attempted, to account for any part of his property to the trustee aforesaid, or to his creditors collectively, by fictitious losses or expenses; or
(2) has within four mouths preceding the presenting of a bankruptcy petition, pawned, pledged, or disposed of otherwise than in the ordinary way of business, any property which he has obtained on credit and not paid
tor: or
(3) obtains credit for more than £20 without disclosing to the person from whom he obtains it that he is a bankrupt; or
(4) makes any false representation, or does
any other act for the purpose of obtaining the consent of his creditors,
or any of them to any agreement, with reference to his affairs or his bankruptcy,
is guilty of a misdemeanour.
311.-Frauds in Bankruptcy by other Persons.
Any person who with intent to defraud the creditors of another person—
(1) within four months before, or after the bankruptcy of such other person, receives any property from him, or fails or refuses to deliver to the trustee administering his property for the benefit of his creditors, any property which forms part of his estate, or conceals any such property; or
(2) in any bankruptcy proceedings makes any false claim, or any proof, declaration, or statement of account, which is untrue in any material particular,
is guilty of a misdemeanour.
