Any person who has charge of any other person unable, by A. 155. reason of detention, age, sickness, unsoundness of mind, or any C. 285. other cause, to withdraw himself from such charge, and unable to provide himself with the necessaries of life, is under a legal duty to supply that person with the necessaries of life, and such duty exists whether the charge is imposed by contract, by law, or by reason of any unlawful act.

CHAPTER XIV.—HOMICIDE,
153.—Definition of Humicide.
Homicide is the killing of a human being by another, directly or indirectly, by any means whatever.
154.--Killing.
An act done before or during the birth of a child which causes its death after it has become a human being, is a killing B. 168,170 within the meaning of the last preceding section.

Causing another person by means of threats, intimidation, or deceit, to do an act which causes his own death is such a killing.
An act which causes the death of a person is such a killing, though
?
(1) it merely accelerates the death of such person while he is labouring under a disorder or disease arising from some other cause; or
(2) death from that cause might have been prevented by resorting to proper means; or
(3) the immediate cause of death is treatment for the bodily injury caused, applied in good faith for the purpose of cure, even if the treatment was improper; provided that if the injury was not in itself of a dangerous nature and the improper treatment was the cause of the death, that shall be a defence to a charge of murder or man- slaughter.
No act or omission influencing the mind alone, except the wilfully frightening of any sick person or child, is such killing ; the causing death by any disease or disorder arising from such influence is not such killing.
Procuring by false evidence the conviction and death of any person by sentence of law is not such killing.
155.—When a Child becomes a human Being.
A child becoines a human being within the meaning of this Code when it has completely proceeded in a living state from the body of its mother, whether it has breathed or not, and whether it has an independent circulation or not, and whether the navél string is severed or not.
156.—Unlawful Homicide.
Homicide is unlawful when it consists in the killing of any person by an unlawful act, or by an omission to perform or observe a legal duty, or by both combined.
