THE LAW OFFICERS to COLONIAL OFFICE.

We were honoured with Mr. Wingfield's letter of the 23rd ultimo, stating that he was directed by you to transmit to us, for our Report, a copy of a despatch from the Governor of the Bahamas, enclosing copies of a correspondence, and requesting our opinion on the question of the right of members of the Legislative Council to vote
in the election of members of the House of Assembly.
That copies of the Colonial Acts referred to in the minute of the Colonial Attorney- General were annexed.
We have taken the matter into our consideration, and have the honour to-
Report,
That in our opinion the House of Assembly was entitled to disallow the vote of the Hon. S. O. Johnson, on the ground that he, being a member of the Legislative Council, was disentitled to give such vote.
It appears that for nearly 100 years such a disqualification has been asserted by reso- lution of the House of Assembly, and having regard to the fact that the resolution was acted on in 1868, we think its validity is maintained by section 72 of the Election Law of 1885, which reserves the privileges of the House of Assembly as hitherto enjoyed and exercised.
