Lincoln's Inn, April 27, 1865.
We are honoured with your commands, signified in Sir Frederic Rogers' letter of the 15th of April instant, stating that he was directed by you to acknowledge our Report of the 5th instant as to the propriety of the consecration by the Archbishop of Canterbury upon Her Majesty's mandate without Letters Patent of Mr. Mackray as Bishop of Rupert's Land.
Sir Frederic Rogers was also pleased to state that you desired him to observe that his letter of the 1st instant was not intended to imply that the issue of Letters Patent would be at once discontinued, and that this was to be the first example of a new practice. That it is, however, your intention not to advise the issue of any more Letters Patent until the whole case and general state of the law shall have been fully investigated and considered.
Sir Frederic Rogers was further pleased to state that the Bishopric of Rupert's Land cannot, without inconvenience, wait for this probably not very brief process. You, were, therefore desirous of ascertaining whether by adopting the course you have suggested for the present case you might not meet the present want, and leave the general question open for full and unprejudiced consideration hereafter.
In obedience to your commands we have taken this matter into consideration, and have the honour to

That we think the course which is now explained to us as that which it is proposed to adopt on the present occasion of the vacancy of the Bishopric of Rupert's Land will have the effect which is desired of leaving the general question as to the ex- pediency of Letters Patent open for further discussion, and at the same time causing the present vacancy of the See to be filled up by the appointment of a successor. recitals, in the form of mandate, used in Canada, which was sent to us with the former papers, will (of course) require alteration, in order to adapt that form to the circumstances of the present case.
