We are honoured with your commands, signified in Sir Frederic Rogers' letter of the 25th instant, stating that he was directed by you to transmit to us, for our con- sideration, an Act passed by the Legislature of Queensland "To prevent the fraudulent
marking of merchandise, and to provide for the registration of trade marks." Sir Frederic Rogers was also pleased to enclose an extract from a letter from the Lords of the Committee of Privy Council for Trade, to whom the Act was referred for any observations their Lordships might have to offer it.

Sir Frederic Rogers was further pleased to state that you desired him to call our attention to clauses 2, 4, and 7 of the Act, and to request that we would inform you whether the 2nd clause is, in our opinion, open to the objection raised by their Lordships.
In obedience to your commands we have taken this matter into our consideration, and have the honour to

That we are of opinion that the 2nd section of the Queensland Trade Marks Act is open to the objection suggested by the Committee of Council for Trade, viz., that its effect would be, as suggested by their Lordships, to preclude all remedy at law or in equity in Queensland for any injury arising from the fraudulent use of an unregistered trade mark.
