The Select Committee recognises that the proposed establishment is only to be regarded as the nucleus of the Excise Department; and that as the new law comes into full operation, and the preventive work is extended, frequent and con- siderable additions will have to be made to the staff in order that the duties for the execution of which the Department is instituted may be efficiently and thoroughly The Select Committee thinks, however, that the establishment now performed.

proposed will suffice for the first financial year, dating from July 1 next, during which period the work of the Excise Department will necessarily be to some extent of a tentative and experimental character.

12. It is noted that the estimate before us exceeds the sum of Rs. 300,000 voted on account of this Department under Miscellaneous Services in the Supply Bill for 1912-13 by Rs. 52,157; but we do not recommend that supplementary pro- vision be sought until the necessity therefor has been actually demonstrated.

The rates of pay proposed and the allowances attached to the various posts have been calculated upon a fairly liberal scale, and we regard this as essential, having regard to the responsible duties which will be entrusted to the officers of the Department, and the temptations to which, inevitably, many of them will be from time to time exposed.

We recommend the addition of the following words to Section 9:-" or a bond executed for the payment of such duty." Experience in connection with the Customs Ordinance has recently shown the necessity for a similar amendment.

It was recommended by the European Rural Member, and approved by the Select Committee, that the words or coca plant " be inserted in Section 14 (b) after the word "indica," it being represented by him that the planting and growing of coca, from which an intoxicating drug manufactured, may hereafter with advantage be subjected to a licensing system.

With reference to Section 14 (c) and (d), after prolonged discussion the Select Committee unanimously arrived at the conclusion that it would not be wise to exclude trees from which sweet toddy is drawn for consumption while unfer- mented, or for the manufacture of jaggery from the operation of this section. The reason upon which the Select Committee bases this conclusion is that, for the better control of the manufacture and consumption of fermented toddy, it may prove to be necessary to license and regulate the drawing of toddy from any toddy-producing tree, and that machinery to enable this to be done should therefore be retained in the Ordinance.

17. The Select Committee, however, is unanimously of opinion that any such licences should be granted free of any charge to the drawers of sweet toddy; and that arrangements should be made whereby such licences shall be issued to applicants locally by officers of the rank of Koralas and Udaiyars.

18. The Select Committee also considers that the retention of the power con- ferred by this section is necessary in order to enable local areas where toddy is not at present drawn to be excluded from the operations of toddy renters, with a view to preventing the spread of the habit of toddy consumption. The retention of the power is, moreover, considered necessary by the Select Committee to enable the lime washing of pots used for the reception of sweet toddy being insisted upon in localities where they are used at the present moment; and, further, to enable the extension of this practice being enforced when and where it may hereafter be found to be desirable.

19. The Select Committee recommends the further amendment of Section 14 by inserting the paragraph beginning "Except under the authority," &o., at the beginning, instead of at the end of the section. The marginal note should be similarly amended.

The Select Committee recommends the following amendments to Section 15:-

(i.) The deletion of sub-section (1) (b) and (d).

(ii) Sub-section (1) (c) to become sub-section (1) (b).

(iii.) To insert now sub-section (1) (c) as follows:-

(0) Subject to the provisions of Sections 26 and 27 discontinue any

distillery, brewery, or warehouse.

21. The Select Committee recommends the amendment of Section 20 by the insertion of the words " and subject to the approval of the Government Agent after the numerals " 18" in the first line.

22. The Select Committee recommends that the heading of Chapter V. be altered from "Duty" to "Duties on Excisable Articles.”

28. The Select Committee is unanimously of opinion that the power to impose duties on excisable articles conferred by Section 21 should be exercised, not by the
