to appoint peons, or men of similar subordinate rank, in the manner in which similar powers are at present granted to the General Manager of the Ceylon Government Railway. It should not, we consider, be used to delegate the power of appointment to posts of any importance, or carrying emoluments exceeding a very modest limit.

Similarly, with regard to the delegation by the Governor under this sub-section of the powers conferred upon him under Section 11 of the Ordinance, we consider that the extent to which such delegated powers are to be exercised should be clearly laid down when such delegation is made; and that the delegation under this sub- section of powers conferred by Section 18 of the Ordinance should relate to minor matters, not to matters of primary importance, as, e.g., the letting of arrack rents over large areas, &c.

As a general principle, moreover, we consider that the powers of delegation conferred upon the Governor by this sub-section should be used not for the purpose of emancipating the Excise Department from efficient control, but merely for the purpose of avoiding constant and unnecessary applications to the Governor for power to act in matters of detail, and to carry on the ordinary duties for the execution of which the Department is instituted.

9. We recommend that Section 8 be amended to read as follows:-

8.--(1) All orders passed by the Excise Commissioner or by a Government Agent under this Ordinance shall be appealable to the Governor in Executive Council in the manner provided by the rules made under Section 31 (2) (c).

In considering this chapter, which relates to Establishment and Control, the Select Committee has examined and approved the proposals formulated by Government for the establishment, emoluments, and distribution of the staff with which it is proposed to initiate the work of the Excise Department, and also a statement showing the Special Expenditure which it will be necessary to incur on account of the experimental distillery, the purchase of motor cars, and other similar services. The statements in question are as follows:-
