ingly, confirming it by despatch only, and not by Order in Council.

But whether these reasons be acquiesced in, or not, is quite immaterial as regards the question of the lawfulness of the proceedings of the "Arrow," inasmuch as the confirmation of the second Ordi- nance-which had no effect till confirmation, sec. 4 -could not have reached the Colony (as has been already said) until a month after those proceedings; nor, indeed, if we had waited for a Council, until much later date.
