At the Court at Windsor, the 30th September, 1825.

Present:

THE KING'S MOST EXCELLENT MAJESTY IN COUNCIL

WHEREAS, by a certain Order in Council, bearing date the 14th day of June, 1722, provision is made, and certain regulations are established, respecting the conduct to be observed by the Governor, Lieutenant-Governor, or other person, administering the government of His Majesty's garrison and territory of Gibraltar, in granting Mediterranean passes to or in favour of certain ships and vessels in the said Order particularly mentioned; and whereas it is expedient that the said Order in Council should be revoked, and that other provisions and regulations should be substituted in lieu thereof; it is therefore hereby ordered by His Majesty, by and with the advice of his Privy Council, that the said Order in Council of the 14th day of June, 1722, and all the regulations and provisions therein contained, shall be and the same are hereby revoked and absolutely repealed.

And it is hereby further ordered, that it shall and may be lawful for the Governor, Lieutenant-Governor, or person administering the government of the said garrison and territory of Gibraltar, for the time being, on application to him. for that purpose made, to grant and issue passes, commonly called Mediterranean Passes, to or in favour of such ships and vessels as are hereinafter mentioned and described (such passes being first transmitted to him for that purpose, by or under the authority of the Commissioners for executing the office of Lord High Admiral of Great Britain); and the said Governor, Lieutenant-Governor, or other person, administering the government of the said garrison and territory for the time being, is hereby required, commanded, and enjoined, NOT to grant or issue any such Mediterranean passes or pass as aforesaid, or any oertificates or certificate, or other instruments or instrument, of what nature or kind soever, for the purpose of investing any ship or vessel with the national character of a British ship, or for the purpose of enabling any ship or vessel to navigate any seas or sea, under the protection of His Majesty, save and except only to and in favour of the ships and vessels hereinafter particularly mentioned and described.

And it is hereby further ordered, that the said Governor, Lieutenant- Governor, or other person administering the government of Gibraltar for the time being, shall and may, on application to him for that purpose made, grant and issue such Mediterranean passes as aforesaid, to or in favour of any British ships or vessels, duly registered, owned, and navigated, according to and in pursuance of any Acts or Act of Parliament for the registry of British shipping.

And it is hereby further ordered, that such Mediterranean passes, as afore- said, shall and may be issued by such Governor, Lieutenant-Governor, or person administering the government of Gibraltar, for the time being, on application to him for that purpose made, to or in favour of any ship or vessel wholly built in the United Kingdom of Great Britain and Ireland, or in some or one of His Majesty's colonies, plantations, settlements, territories, or possessions beyond the seas, or to or in favour of any ship or vessel which hath been lawfully condemned by any Court of competent jurisdiction in His Majesty's dominions, either as prize of war, or under and in pursuance of any Act or Acts of Parliament relating to His Majesty's revenue, or made for the abolition of the African Slave Trade: Provided always, that the owner or owners, and master- mariner, and three-fourths parts in number, at the least, of the seamen, navi-

gating any such ship or vessel, be natural-born subjects of His Majesty, or have or hath, when on shore, been resident at, and had their, his, or her, settled domicile and place of abode at Gibraltar aforesaid, for and during the full term of fifteen years next preceding the time of granting and issuing any such pass as aforesaid.

such pass as And it is hereby further ordered, that before granting any aforesaid, to, or in favour of, any ship or vessel not duly registered, and owned, and navigated, according to and in pursuance of some Acts or Act of Parliament for the registry of British shipping, the said Governor, Lieutenant-Governor, or person administering the government of Gibraltar for the time being, do and shall require from the person or persons applying for any such passes or pass, sufficient proof, on oath (and which oath such Governor, Lieutenant-Governor, or other person as aforesaid, is hereby authorised to administer), that such vessel hath been so lawfully condemned as aforesaid, and that the owners or owner, master-mariner, and seamen thereof, are respectively natural-born subjects of His Majesty, or have or hath, when on shore, been resident, or had his, her, or their settled domicile or place of abode at Gibraltar aforesaid, for and during the before-mentioned term of fifteen years.

Provided nevertheless, and it is further ordered, that it shall and may be lawful for such Governor, Lieutenant-Governor, or other person administering the government of Gibraltar for the time being, to grant and issue any such pass or passes as aforesaid, to or in favour of any boat, sloop, schooner, or other vessel or craft, of the burden of forty tons, or of any smaller burden, to or in favour of which any such passes or pass have or hath been actually granted, at any time previous to the date of this present Order.

And it is hereby further ordered, that the said Governor, Lieutenant- Governor, or any other person administering the government of Gibraltar for the time being, do transmit to His Majesty, once at least in each quarter of a year, through one of His Majesty's Principal Secretaries of State, a full and accurate account of the several ships and vessels to or in favour of which any such passes as aforesaid may have been so granted during the quarter of a year next preceding the date of any such report, distinguishing the names and tonnage of all such ships, with the places and times at which they were built or condemned as aforesaid, with the names of the owners and master-mariners thereof, respectively, together with copies of all affidavits made, in pursuance of this present Order, by any person or persons applying for any such passes or pass.

And the Right Honourable Earl Bathurst, one of His Majesty's Principal Secretaries of State, and the Commissioner for executing the office of Lord High Admiral of Great Britain, are to give the necessary directions herein as to them may respectively appertain.
