Mr. Shum Wai Yau enclosed with the despatch at 14 is given in my minute of the 7thOctober. The Governor's despatch about this case at 14 has crossed with our telegram to him at 13.

The despatch confirms what we had heard from Messrs. Reid Sharman and Company that the Chinese Government hademade an application for the surrender of Shum Wai Yau under the Chinese Collaborators (Surrender) Ordinance, a copy of which is in file 54343 attached. The Governor considers that the Chinese have made out a reasonable case for the surrender of Mr. Shum and has therefore authorized his arrest and detention in order to prevent his escape while further enquiries are being made.
3. The Chinese Government's case chiefly rests:-

(a) on the statement that in 1943 Shum
organized a cultural excursion to
Japan and wrote a favourable account afterwards of his impressions;
(b) on the statement that in 1945 he went
to Canton and organized pro-Japanese propaganda;
(c) on a large number of extracts from
the war time issue of his paper the "Wah Kiu Yat Po".
As we have not seen any of these press extracts, and have no more than the bald statements referred to in (a) and (b)
