There are now two outstanding matters on these papers.

The first is the question of the flight which was to be made by a Dakota aircraft V.R.H.D.A. belonging to the Roy Farrell Export Import Company, which was to fly from Hong Kong to London carrying the delegation of the Chinese Government to a Telecommunications Conference at Moscow.

The situation about Mr. Roy Farrell and his Company is one of some complexity and I have discussed the question with Mr. Freese-Pennefather at some length. Mr. Roy Farrell is an American citizen. He appears to own a company called the Roy Farrell Export Import Company which is registered in Australia. The aircraft which this Company possesses have British markings and Mr. Farrell has approached the Governor of Hong Kong with a request that the Governor obtain for him the necessary clearance for the flight of an aircraft belonging to his Company to Switzerland. The necessary clearance was obtained by the M.C.A. from Burma, India and Malta, but the Foreign Office wished to know when the flight would begin before they would obtain the necessary clearance.

The next step in the correspondence came at (89), when the question of the Chinese delegation to the Telecommunications Conference was first brought up. The F.0. said at this time that they were quite unable to obtain route clearance in the time available. Subsequently, Mr. Freese-Pennefather has informed me that the Chinese delegation arrived for the Telecommunications Conference in Moscow, so that the whole case now appears to have misfired slightly. Nevertheless, at (102) the Governor of Hong Kong comes back with a request that we proceed to obtain the clearance necessary for this flight as the flight itself has been delayed whilst awaiting this clearance.

If Mr. Roy Farrell were a British subject and his Company were registered in Hong Kong there would be no difficulty whatsoever in obtaining the necessary clearance for this flight; but Mr. Farrell is an American citizen and his Company appears to operate not only in Hong Kong but also in Shanghai and cities in China. The Company is furthermore registered in Australia, so that Mr. Farrell's claim upon the good offices of the Governor of Hong Kong

to persuade the F.0. to make the necessary approaches to the foreign governments concerned to obtain clearance for this flight, we must be in a position to assure them that our action in so doing is correct, and I think it would be worth while for us to addres8 them on the matter, pointing out that the Export Import Company concerned is registered in Australia, that Mr. Farrell appears normally to be resident in Hong Kong, and that therefore we do not consider that there can be any serious objection to our obtaining the necessary clearance from foreign countries for

The second outstanding matter on these papers is the proposal made by the Governor of Hong Kong in his despatch at (92) for the provision of an international airport at Deep Bay. The success or failure of this proposal depends in the first instance upon the policy of the M.C.A., and it is clear
