Addition of new regulations 18A and 18.

The principal regulations are amended in Part 1 by adding after regulation 18 the following new regulations—

"Examina- tion, in- spection. weighing

and testing of motor vehicles.

18A. (1) The Commissioner before-

(a) registering a motor vehicle;

(b)

issuing a registration book or a duplicate thereof to the owner of a motor vehicle;

(c) returning the registration book to a new registered owner under paragraph (3) of regulation 13; or

(d) issuing a motor vehicle licence, may, by notice in writing served either personally or by registered post upon the owner of the motor vehicle or the new registered owner, as the case may be. require production of the vehicle for examination. inspection, weighing and testing at such vehicle testing centre and at such time as may be specified in the notice for the purpose of ascertaining whether the motor vehicle-

(i) accords with the particulars thereof entered

in the register or contained in any form of application for registration or notice of transfer of ownership;

(ii) is roadworthy;

(iii) together with its equipment is constructed, adapted, maintained, painted and marked and bears signs in accordance with the Road Traffic (Construction and Use) Regulations, and any other enactment and any conditions subject to which a motor vehicle licence has been issued in respect of the vehicle having regard to the class or division of the class within which application has been made to register the motor vehicle or within which it has been registered.

(2) The Commissioner or any police officer, by notice in writing served either personally or by regis- tered post upon the registered owner of a motor vehicle, may require production of the vehicle for examination, inspection, weighing and testing at such vehicle testing centre and at such time as may be specified in the notice, for the purpose of ascertaining whether it-

(i) accords with the particulars thereof entered

in the register:

(ii) is roadworthy:

(iii) together with its equipment, is constructed, adapted, maintained, painted and marked and bears signs in accordance with the Road Traffic (Construction and Use) Regulations. and any other enactment and any conditions subject to which a motor vehicle licence bas been issued in respect of the vehicle having regard to the class, or division of the class. within which the motor vehicle has been registered.

(3) For the purposes of these regulations, the Commissioner may by notice in the Guzeite designate any place as a vehicle testing centre.

(4) The owner or registered owner, as the case may be, of any motor vehicle who fails to comply with a notice served upon him under paragraph (1) or paragraph (2) of this regulation shall be guilty of an offence and shall be liable on conviction to a fine of one thousand dollars and to imprisonment for six months.

(3) A police officer may examine and enter any motor vehicle which is on a road or public place, for the purpose of ascertaining whether—

(a) the vehicle is being used in accordance with the Ordinance with any other enactment and with any conditions subject to which the motor vehicle licence has been issued; (b) the condition of the vehicle and its equip- ment complies with the Road Traffic (Con- struction and Use) Regulations and any other enactment.

(6) Any police officer who, as a result of any examination of a motor vehicle conducted by him under paragraph (5), has reason to believe that-

(a) the vehicle has been involved in an accident; (b) the vehicle is not roadworthy: or (c) the condition of the vehicle or any of its equipment does not comply with the Road Traffic (Construction and Use) Regulations or any other enactment,

may direct the driver of the vehicle to drive it to such vehicle testing centre or police station as the police officer may specify, or may direct the driver and any
