regulation 29.
(b) for the words "pensionable service" wherever they occur, there shall be substituted the words "public service"; and
(c) for the words "pensionable emoluments" wherever they
occur, there shall be substituted the word "salary": Provided that where the officer at the date of retirement is employed in a post the minimum of the scale of salary of which amounts to six hundred and twenty-four dollars per annum less and who prior to the commencement of this regulation was not in the servics of this Colony no annual allowance may b granted but it shall be lawful for the Governor to award a gratuity to such officer not exceeding five times the amount of the annual allowance which might have been granted to him under this regulation but for this proviso.”.
7. Regulation 29 of the principal regulations is revoked and replaced by the following-
"Gratuity payable
where a non- pensionable officer dies fo the acrvice of the Colony.
29. (1) Where no gratuity can be granted under section 16 of the Ordinance a gratuity may be granted to the legal personal representative or, in case the gratuity does not exceed five thousand dollars. to such dependants as shall be named by the Governor, of a non-pensionable officer who dies while in the service of the Colony and- (a) who bas completed three years unbroken service:
(b) whose death was caused in the discharge of his duty or as a direct result of injuries received whilst on duty or by illness specifically attributable to the nature of his duties.
(2) A gratuity granted under this regulation shall be of an amount to be determined by the Governor but shall not exceed-
(a) if the officer was paid monthly-
(i) nine months' salary; or
(i) the commuted annual allowance gratuity, id
any.
whichever is the greater; and
(b) if the officer was paid daily, one hundred and
eighty days' pay.
(3) A gratuity granted under paragraph (1) to the legal personal representative shall form part of the estate of the officer for the purposes of distribution but, neverthe less, no estate duty shall be payable in respect thereof, and

this addition to the principal value of the estate shall not be taken into account for the purpose of increasing the rate at which estate duty on the remainder of the estate may be payable.
(4) In paragraph (2) "commuted annual allowance gratuity" means the gratuity, if any, which might have been granted to the officer under paragraph (4) of regulation 26 if he had retired at the date of his death in the circum- stances described in sub-paragraphs (a) and (c) of paragraph (3) of that regulation and had elected to receive a gratuity and a reduced annual allowance.".
& Regulation 33 of the principal regulations is revoked.

The Schedule to the principal regulations is amended-—— (a) by the deletion of the item "Colonial Audit Department
(Home Establishment)";
(6) by the deletion of the item "Crown Agents for the Colonies"
and the substitution therefor of the following-
"Crown Agents for Oversea Governments and Adminis- trations";
(c) by the addition after the item East African Railways and
Harbours Administration" of the following-
Revocation of regulation 33.
Amendment of Schedule.
"Employing Authorities under the Overseas Service Act, 6 & 7 Eliz 1958":
[4] by the deletion of the item “Employing Authorities under the Colonial Superannuation Scheme" and the substitution there- for of the following-
"Employing Authorities under the Oversea Superannua- tion Scheme"; and
(e) by the addition after the item "Nyasaland" of the following-
"Overseas Audit Department (Home Establishment)".

10. No pension or gratuity which has been paid before the date Saving. of coming into operation of these regulations shall be reduced thereby.
