not for placing their things on the streets that causes obstruction, but for hampering street cleansing services provided by the Department. Since the current problems are related to shop operators obstructing street cleansing, therefore the prosecution actions are taken by the Cleansing Section of the Department. Other cases of street obstruction will require the Health Inspectors of the Department to take prosecution actions, and the relevant legislation is different and the fine is also higher. At present, the penalty for these cases is a maximum fine of $5,000 or imprisonment of 3 months, which is different from the penalties for obstruction to street cleansing.

IV MOTIONS

1. Ms. GRACE AU YUK-HAR, Vice-Chairman of the Recreation Select Committee, moved the following motion:

*RESOLVED that the Public Health and Municipal Services Ordinance (Public Pleasure Grounds) (Amendment of Fourth Schedule) (No. 7) Order 1995 and Public Swimming Pools (Designation) Order 1995 be made under Sections 106 and 42A respectively of the Public Health and Municipal Services Ordinance, Cap. 132.

She said (in Cantonese):—As Vice-Chairman of the Recreation Select Committee, I rise on the motion standing in my name:

*RESOLVED that the Public Health and Municipal Services Ordinance (Public Pleasure Grounds) (Amendment of Fourth Schedule) (No. 7) Order 1995 and Public Swimming Pools (Designation) Order 1995 be made under Sections 106 and 42A respectively of the Public Health and Municipal Services Ordinance, Cap. 132.'

The purpose is to amend the Fourth and Fourteenth Schedules of the Public Health and Municipal Services Ordinance, Chapter 132 to include four new venues viz: Po Kong Village Road Indoor Games Hall, Urban Council Wong Nai Chung Complex Indoor Games Hall, Hammer Hill Road Leisure Pool and Jordan Valley Leisure Pool; and to delete two existing public pleasure grounds, viz: Hoi King Street Sitting-out Area and Science Museum Rest Garden.
