A British subject asked recently through Swise Government for guidance from His Majesty's Government in the United Kingdom as to the propriety of his continuing to function as Secretary of Shanghai Municipal Council.

2. We have informed Swise that we expect patriotic British subjects to refrain from assisting ensay war effort, but we should not regard as unpatriotic the participation of British subjects in such maintenanse of essential services as is for benefit of civil population of occupied territory. We understand that British subject in question had already resigned but we have asked Swiss to inform their Charge d'Affaires at Shanghai and instruct him to reply accordingly should other British subjects seek advice.

3. Before replying we consulted United States Government who stated that they had issued no comparable instructions as they had received no request for advice from United States citizens in China, but they agreed that our reply was the only one which could be given in present circumstances.
