INDIAN CON TRIBUTION TO HOME EFFECTIVE CHARGES OF THE BRITISH

2. The Secretary of State for India asked
the Cabinet to amend the Terms of Reference
Lord
as set forth in the Cabinet Conclusions of
the Meeting referred to in the margin.
Birkenhead pointed out that, in a small but
important particular, the Terms of Reference
to the Sub-Committee as stated by him appeared
to have been misunderstood, namely, the third
Term of Reference, which should read:-
*What powers could be exercised
in the matter vis-a-vis the Secretary of State for India in Council", not vis-a-vis the Government of India”.
He pointed eut that it was the Council of India
in London which constitutiomlly was in a
position to voto the proposals of His Majesty's
$
Government on the one hand, and, on the other,
of the Government of India, in respect of the
charges on the revenues of India.
Lord Birkenhead
also suggested that the opportunity should be
taken to re-arrange the order and make some
verbal alterations in the other two Terms of
Reference for the purpose of making them conform more closely to the problem to be considered as it
now stands, which he suggested should read as
follows:-
...... to consider and advise -
(I) What powers could be exercised
in the matter vis-à-vis the Secretary of State for India in Council.
(II) On the question of principle how the claim of the Govern- ment of India that there should be no contribution by India should be dealt with.
(III) How the amount of the contri-
bution, if any, should be determined.
