After giving his testimony. Mr. Wallace said that the Supreme Court's ruling that the processora should have the escrowed taxes returned to them was "probably the greatest retrogres sive step in American history."
Ile expressed the opinion that the proposed substitute for the AAA. was constitutional, but "being con- stitutional means one thing and the passing by the Supreme Court means another."
The Chairman of the Senate Agri- culture Committee, Senator Ellison D. Century Smith, Democrat of South Carolina, said that the United States Solicitor General likewise thought the subali- tute was constitutional. However, he refused to give a direct opinion to Senator Smith.

Senatur Smith also explained that the Solicitor-General had thought the A.A.A. constitutional, hence he was naturally reticent in giving a direct opinion on the substitute,
Mr. Henry Wallace and that in the Hoosne Milla case, the Suprema Court had disapproved of the Govern- ment taking money fram ane group for the benefit of another.
"Yol," he said, "in giving the pro- consors $200,000,000 from all people we see the most flagrant example of expropriation for the benefit of phe group."
Meanwhile, in the House of Repre- sentatives, Representative D.fi, Cross, Democrat of Texas was.delivering a speech urging the enactment of a law which would curb the power of the Supreme Court.
