The hearing of 14

claim for $1,000, balance due on a car sold to Albrecht Sander, c/o Messrs. Sander, Weller and Co., Des Vocux Roal, on April 30th of this year, made by the Astatie Motor Car Co. Ltd., 439-445, Honey Rond. Wanchal, was continued at the Supreme Court this morning before the Pulsne Judge

(Mr. Justice Wood).

At a previous hearing the clam was admitted by defendant, who Mr. Nigel was represented by (Mensra. Johnson, Stokes hd Master) and who issued a counter 'claim In which he atated that at the time of the sale the ear was warranted to be the latest model "Auburn Custom Sedan, which car contains certain features of con struction, namely Starisix, Lovejoy ride-control hydraulte nhock ub- norbers, and dual ratio. The car suppled to defendant was not the latest model but a 1931 model and did not contain the sperm fea tures enumerated.

It was warranted at the time of sale to be in perfect running con- dition and without any defects. The car was, in fact, not in Jun- ning order and the sum of $72.40 had already been spent y de- fendant in putting the ear in good running order. RUNNING WELL.

When he paid the second cheque, Mr. Sander stated he had not enough money to pay the balance. When witness asked him when he would pay, he said he would pay by the end of May. He then referred to the car as "all right and running well." Mr. Sander made to enm- ment about the car not being a 1582 model. Later in May, wit- neas saw Mr. Sander again about payment but there was no mention of the mulet of the cat. Mr. Sunder stated he had no money at the moment.

On the way they discussed the price and witness told Mr. Sander the car would cost $5,700 cash. SALE EFFECTED.

Witness went with Mr. Chan to see Mr. Sander on April 26th, when the latier told him the Studebaker for $5,000. Witneas Hongkong Hotel had offered the
