£50,000 APPEAL. the first CHRISTMAS GIFTS
LEVER BROS. WIN.
London, Nov. 21.
The appeal against Mr. Justice Wright's decision ordering £50,- 000 to be repaid to Messrs. Lever Brothers by Mr. E. H. Hell, of Harrogate, and Mr. W. E. Snoll- ing, of Putney Heath, was dis- missed by the Appeal Court,
Mesars, Bell and Snelling were formerly chairman and vice- chirman of the Niger Company, and they were paid £30,000 and £20,000 respectively Ra compensa. tion when the company Amal- gamated with the African and Eastern Trade Corporation. They admitted having received £1,360| In respect of four private deals in cocos, and this was also ordered to be repaid.
In the King's Bench Division (where the hearing lasted three weeks and cost £20,000) the jury found that Messrs. Lever Brothers
would have exercised a right to terminate Mesara, Bell and Snell Ing'a contracts of service had they known of the dealings, but the jury also found that there was no fraudulent misrepresentation or concealment by the defendants in
not disclosing the rdered re-
Mr. Justice Wright payment on the ground that there hat been a mutual fundamental mistake as to the nature of
the agreement concelled, and the de- fendants appealed on the ground that mutual misinke hul got bers plended.
Servants Obligation.
Lord Justice Serulton said that mutual mistake could make a con- tract void. He added:
I do not propose to lay down any definite rule for ground of dis closure by servantą, but in my opinion the defendants were un- (der an obligation, before termina- tion of their service agreement, fo disclose any breach of that con trast, and the contract minnie could be declared void by this non-disclosure.
in
Lord Justice Lawrence and Lord Justier Greer agreed, and the ap- peal was dismissed with costs.
"Had Enough Rope."
Mr. Miller asked for a slay with a view to appeal to the flouse of Lords.
Lord Justice Serutton: Don't You think you have had enough rope and had better du something about the money? Will it be brought into court? This is ant a time to leave money lying about. We think ought to put the money in joint names if you wunt
a stay.
were
Mr. Miller: Would you think we were meeting the position If w
to undertake to bring into court half the amount, £25,000?
Mr. Lewis (for Messrs Lever): The whole amount should be paid into court. We do not know what the financial position of these men is now. My information is that Mr. Snelling is in France, where he has been for some time. Mr. Bell is here,
Lord Justice Serulton: If a petition to the House of Lords' is lodged within three weeks Mr. Bell may appeal if he brings in £30,000 ind Mr. Snelling if he brings in £20,000.
