Continuing his cross-examination of Lam Pak-hing, Managing Part- ner of the firm, who is appearing as the complainant in the case, Mr. F. C. E. Rendall asked if it

was not a fact that pressure had to be brought to bear, by means of a solicitor's letter, to compel Lam to refund a deposit of $7,000 pút into the firm by Mow Chuen-man, a former Accountant.

Witness admitted that such a letter was seat, but be denied that it was the immediate cause of his returning the desposit. He said he had to go into the account books kept by Mow. Not until he had satisfied himself that everything was all right did he return the de- posit.

There had been some talk wit- ness said, of Mow becoming a part. ner, but that did not progress be- yond the stage of its being discussed as a mere possibility. He denied that Mow resigned because he was dissatisfied with the way in which the inner account books were being kept.

Mr. Rendall put it to witness that the real reason why witness had not paid the $7,000 when it was first asked for, was because witness did not then have the money; that in point of fact he was procrastinat ing with the view "to warding off the evil day."

Witness returned a denial to this, and to a further suggestion that certain sums which he received from money toun associations and other sources were accumulated for the eventual purpose of paying off this deposit.

The hearing was adjourned until this afternoon.

The Apostelic Delegation this morning received a telegram from Kiukiang, stating that the Catholic Bishop, Monsignor Mignani, and some priests and sisters, had been seized by Communists at Kian, Kiangsi.

The Bishop and one priest have been released on bail-Reuter.

Shanghai, Oct. 21.

The captives taken at Kian be- xides Bishop Mignani numbered six priests and ten sisters, com- prising Italians, French and Chinese, of whom four of the sisters are Chinese.

Complainant alleged that he was accoated by defendant op- posite the Hongkong Hotel in Thursday last, and accused of Pedder Street at 10 am being a pickpocket. Complainant denied this, and was struck in the chest, Defendant then de- manded $2 from the youth, who promised to obtain the money and accordingly a meeting-place was arranged. Complainant, however, went to the Police and made a

report, returning later and hand notes, the numbers of which had ing over the $2 to defendant in already been taken by a police officer.

The evidence of Detectivo Ser geant Paton was that after com- plainant had walked away from defendant the former, as arranged, pointed towards the man, who saw the signal, and asked witness what was the matter. Complain- aut pointed to the ground near defendant, where two dollar notes were lying. They were picked up, and the numbers corresponded with those previously noted.

In reply to Detective Inspector J. Murphy, witness said that it was possible for complainant to have thrown the notes near the defendant.

His Worship registered a conviction and passed sentence of two months' hard labour.
