JUDGMENT GIVEN.·

Following a long address to the Court, on which he was compli- mented by the Chief Justice (Sir Joseph Kemp), and which, His Lordship admitted, contained many points of substance and im portance, judgment was given against Mak Chun-loong, the de- fendant in a case at the Supreme Court, which has lasted six days. Mak Chun-laong was sued by Chan Wo-po- and other partners in the Po On Company of Canton, for the return of a launch, which it was alleged, was fraudulently mortgaged to Dr. Basto,

Defendant's Submissions. The defendant, in addressing His Lordship, submitted that evidence given in the case for the plaintiffs, was false. He would like to em- phasise that if the Deed of As- signment had really been on board the launch, it should have been stolen by the "Reds", when they pirated the launch and stole money and arms from it. It was defen- dant himself, and not Mak Kat- cheung, who had the Deed of As signment.

He (defendant) also had the Power of Attorney, so that it could not possibly have been on the launch as the plaintiffs contended, as he was never there.

The plaintiffs knew that Dr. Basto was a man of money and had therefore dropped the case against him, and had taken up one against

Notwithstanding the fact that he had no money to pay for Counsel, or no time to get the money for Counsel, he had come there himself to defend the case and to prove to the Court that he was perfectly honest and that his case was a true one. The plain- tiffs had got counsel and solicitors to write down every piece of evi dence, but he had had to keep every- thing in his head, and unless he was speaking the truth, how would he have such a wonderful memory to bring out the case so success fully?

Police Satisfled,

He submitted that the police were perfectly satisfied that his name was Ng Shing. One could not give a name at random when applying for an arms licence, for the police spent a month in making enquiries as to the genuineness of the name, and he had also registered his name as Ng Shing at the Yaumati

Police Station.

Association Canton Navigation produced a certificate dated 1928, and not one of the year the launch was first registered. On the other hand, there were points in defen- dant's ezidence which were in his favour. It was quite true that the fact that he went to the police sta tion and informed the police about himself was in his favour. It was also true that the witness from the Harbour Office gave evidence of the fact that Mak Kat-cheung told him that defendant's name was Ng Shing, but His Lordship was of the opinion that it was quite possible that he imagined it that he honestly imagined it.

He thought that the defendant had relied too much on the fact that he won his case at the Criminal, Sessions last year, but he would point out that at the Criminal Sea- slors it was merely that the pro- secution failed to prove their case.

Even if he had induced himself to believe that he was Ng Shing, it was quite, clear that he was not.
