BOATMEN'S FIGHT ENDS FATALLY.

CHARGE OF MANSLAUGHTER

INSTITUTED,

Proceedings against a boatman who was originally arrested on a charge of causing grevious bodily harm to a fellow boatman but later, on the death of the victim, Was accused of manslaughter, wore commenced before Mr. Whyte Smith at the Kowloon Magistracy yesterday afternoon.

Mr. H. Somerset Fitzroy, Public Prosecutor, appeared for the Crown, and Mr. G. S. Hugh-Jones represented the accused,

According to the Crown's case the deceased man, Chan Pen, was on board his junk on March 24 together with certain other people. The accused went on board and

The

cutters who were there. prisoner was alleged to have made certain remarks to the women, and then appeared to have spoken to the deceased and another man. He then left the junk. the deceased and a man named Tang Hing following him. They re- monstrated with him for his re- marks to the women, and a fight ensued. During the fight the deceased man was injured. There were apparently others present, and they helped the accused.

The deceased was injured over the head, and although the Crown did not think it could possibly be proved that the accused was the man who actually struck the deceased with a stone, he Was acting in concert with others who had thrown the stone.

The victim was later taken to the Kowloon Hospital, where he died. Medical evidence would show that the cause of death was tetanus.

Dr. J. T. Smalley gave evidence

that the deceased was admitted to the Kowloon Hospital on April 10 and died from tetanus on the afternoon of April 13. At the request of Mr. Fitzroy, wit ness went 0372 to describe the causes and symptoms of tetanus.

Tang Hing was called, and stated that the defendant threw a stone on to the deceased's junk from the shore. He was chased by witness and the deceased and asked for an explanation. It was then that the deceased was struck. At this stage the case was ad- journed until next week.
