Justification Plea.

In outlining the defence, Mr. D'Almada said that after October 1, when the contract was entered into, Mr. Silva Netto was told by his broker on Sunday, November 4, that the plaintiff arm had aus- | pended payments and tie master had absconded. He himself made personal enquiries and ho was told by the folis in the shop that the master had gone.

Mr. Silva Netto also saw an ar- ticle in the Morning Post of No- vember 5. In view of that article! and another which appeared in the Chinese newspaper, he felt justi- fled in considering the contraet sa rescinded and disposed of the cargo for the best price he could obtain to prevent a possible loss.

In evidence, Mr. Silva Netto said that on November 4 he learned that the firm had suspended pay- ment. He went to the firm in Bon- ham Strand, and, in conversation with the fokis, learned that the master had gone away. In view of these circumstances, his broker advised him to sell the goods to avold n loss. Otherwise he would | have stuck to the contract..
