The defendants were Messra, J. D. Driscoll and A. Miller, trad- ing as the Towor Trading Syndicate, of Harp-inne, E.C.; Mr. T. A. Lindsay, of Mark-lane, K.C., and Mr.. AH. Attfield, of War- wick-road, Worthing.
Mr. W. A. Jowitt, K.C., for Sir Harry Foster, said Mr. Lindsay, a whisky distiller, was to supply 7,500 cases of, whisky to Driscoll and Miller, and Mr. Attfield was to effect the sale in America.
Buying a Ship.
The whisky was to be shipped to. Dublin and then transferred to another
ship. Wearholme. To enable Driscoll and Miller to buy the latter ship Mr. Lindsay ad- vanced £2,500 and Sir Harry Foster advanced £1,000.
It had been arranged that Bir Harry Foster would receive $4,500 and Mr. Aftfold £2,750 out of the profits.
Sir Harry Foster, in cross- examination, was asked if he knew that the whisky was. to be un- lawfully run into America.
He replied that he understood Mr. Attfeld had purchasers who ultimately intended to take the whisky to the United States, "but they would purchase from without risk as far as we 5 concerned.”

W. T. Tilden who is favourite for the J. C. Brown, Singles event, and the Frenchman, Landry. Experience told-in a long and strenuous duel, the Frenchman being the first to show signs of tiring. After leading by two sets to one, ho collapsed and allowed. Tilden to draw level by taking the fourth set after soven games.
