DEAD MAN'S ALLEGED THREATS.
That
the deceased threatened to kill him if ha-refused to jołu ‘a certain triad society and de- manded squeeze to the tune of $30, were given as reasons for killing Wan Leung by Lam Io, who came before the Puisno | Judge, at the Criminal Sessions, yesterday on a 'charge of morder. The Attorney General (Hon. Mr. J. H. Kemp K. C.) conducted the case for the Crown and Mr. N. I. Brewer appeared for the defence. The jury wore Messrs W. H. Coole, RC Chatterton, EW. Duggan, E. V. M. R đà Sousa, R.M. Smith, J. P. Poreira and E. H. R. O'Farrell.
According to the Crown's story. the murder occurred in a tane at Shaukiwan West on the evening of Oct. 2nd, prisoner killing de- ceased with an axe. Accused was arrested the same evening in a boat builder's shed.
When charged, accused admit→ ted striking deceased with an axe, stating that deceased had struck him several times this year and last year because he refused to join triad society. At the Police Court, prisoner told the Magis-

trate that deceased tried to "squeeze" him. He demand- ed $30 and · wanted &CCUS- ed
trial society. join a Deceased threatened to shoot him with a revolver, sccused told the Court, and if prisoner had not met him that night deceased would have killed him.
This, the Attorney General submitted, seemed to be a clear confession of acts which in law amounted to murder. There was no suggestion I prisoner's statements that he acted in immediate defence of his own life. There was no suvgestion that he was attacked by deceased and had to use his weapon to defend his own life at that mo- ment. There was not sufficient justification in law for accused

that there was danger was not enough to reduce the crime below murder, but the Attorney General thought he might properly tell the jury that they were at liberty to add any recommendations they might think fit to their verdict.
Accused told the Court yester- day that on the night of Oct. 22nd six men, including the deceased. stopped him and demanded money. One drew a revolver and threatened to kill him. Accused: bolted, bat three of the men gave. chase. Deceased gained on him and fired two shots. Being afraid for his life, accused snatched up an axe and struck the fatal blow. The jury returned a unanimous verdict of "not guilty" and accused was accordingly dis- charged.
