Can a wife refuse to join her husband än Australia :if, before marriage, he promised to make her a home in England?
This was the question raised at Marylebone Police recantly dur Fing the hearing of an application for a maintenance order by Mrs. Elsie Wright, of Christchurch- residences, Marylebone.
She was represented by Me! Foulkes Jones on behalf of the Women's and Children's Protec tion Society:
Mr. Jones said the woman was married to an, Australian soldier in Englandien July 14, 1918. Before the quarriage she said she objected to going to Australia and Whght promised in ruske a home in this country.
On this condition she married him, and when, shortly after- |wards, he left for Australia to be demobilised, it was understood that he would return to live in England. Later he wrote asking her to go out to him.
The Magistrate: Do you say that if a wife marries an Aus- tralian she can make it a condi- tion that he stays in this country?
Mr. Jones: She can make it a condition that she will not marrý him unless he promises to live in England.
The Magistrate: But after marriage can she say, "You must not go back to your own country, and if you do you desert me"?
Mr. Jones submitted that if the husband agreed to the arrange- ment and then after marriage insisted on her living at the other end of the rarth it amounted to desertion.
The magistrate said he was sorry for Mr. Wright in many. ways, but the ease must be dis- missed.
