Paris, October 13.-The follow- ing memorandum has been sub- mitted by the British delegation to the Supreme Council.
By the terms of the Armistice Convention, signed at Treves in January, 1919, Germany agreed to place the whole of the German merchant feet under the con- Itrol and under the flags of! the Allied Powers. The Johann Heinrich Burchard, William O'Swald, Braunschweig, Den- darah, and Nassau have not been delivered. Continued de- mands have been made by the Allied Naval Armistice Commis- sion to the president of the Ger- man Armistice Commission to surrender these vessels. These de- mands were simply ignored and remained unanswered until quite recently,, when Admiral Goette stated that the ships, having deen sold in 1915 and 1916 by the Hamburg Amerika Line and the Kosmos Line to Dutch shipping companies, and were consequent- ly not German but Dutch ships in fact. These ships were with- out question originally built for German companies and were Ger- man property and their transfer! admittedly did not take place until considerably after the outbreak of hostilities. The Germans as well as the Dutch were already well aware that this transfer was invalid, as the ships have not in fact dared to put out to sea in view of the certainty of their capture by the Allies. The impression gained by the naval officer, who inspected the vessels on behalf of the Inter- Allied Armistice Commission is that the Germans fully realised that the ships would have to be surrendered under the Peace Treaty. They hoped is be able to evade their obligation by sup- porting the Dutch claim, and handing over the ships to the Dutch before the ratification of the Treaty of Peace. The Ger- man contention if accepted, would amount to the recognition of the right to transfer the pro-! perty in those belligerent vessels to a neutral after the outbreak of hostilities.
