When the steamer was launched atie Osaka on July 8th the Chinese firm sent its representative, who as soon as the ceremony was over. wanted to pay Y50,000 to Mr. Nakamura as stranged. The latter, however, avoided receipt of the proffered payment on this and later occasions on variou pretexts. Finally the plaintiff's representative was obliged to de- posit the Y50,00, in the Bank of Japan and notified Mr. Nakamura to obtain the money from the bank. Defendant sent a reply to the effect that as plaintiffs had failed to pay the Y50,000 on the occasion of the launch as agreed-☀ up, the contrac" was cancelled and the Yi45,00, bargian money would be forfeited. Thereupon plaintiffs instituted a civil suit against defendant in the Osaka Chiho Saibansho, claiming de- livery of the steamer and, at the same time, made application to the Court for an order prohibiting the sale, transfer, or charter of the vessel pending the settlement of the suit." The Court has granted the application of the plaintiffs. The latter have also, presented an additional claim to the Court asking for payment of Y660,000 damages in the event of defendant's failure to deliver the steamer.

According to articles appearing in the United States papers, the question is looked on as rather a serinus .one. A well-kaozn yachtsman, foreseeing the dif- ficulties that were likely to arise, some time ago suggested to "the" United States Shipping Board' the desirability of a special effort being made to instruct in tech- nical navigation the able sailor- men of the coasting fleet and d'light.fishermen, who might be quickly qualified for licensed officers of merchantships bearing munitions and food stuffs to Europe. This suggestion is now being carried. into actual effect, but what the result of the experiment will be remains to be proved. It is claimed that there are several thousand competent seafaring men along the coast of New England, men of natural intelli- gence and hardihood with a long seasoning of experience, who have neveż acquired familiarity with technical navi- gation because they have only practised dead reckoning and have had no need to take observation and make computa. Our American cousins are well known for their ability to adapt themselves to circums tances, but the true born Ameri can is in the minority in the Mercantile Marine of the counTM try, American ships belog chiefly manned by aliens, chiefly Scandicavians, and should these men notberaturálsed sub jects, another difficulty will arise.
