In the Summany Court, this morning, Tong Lin, sued Teung Yuen and Cheung Ying Sang for the sum of $650; $500 amount deposited with defendants and $150, amount rcosived by the defendants from the plaintiff under a vote of acknowledgment,

Mr. P. W. Goldring, appeared for the plaintiff and Mr. C. F. Macon, of. Messrs. D'Almada and Mason, appeared for the defendant. Mr. Maron contended that this

a contract to supply a certificate to the plantiff to enable him to enter the United States of America, the plaint not coming within the exempted class. This was held by Mr. Justice Gom- pertz in action 5011 of 1909, to be illegal.

Mr. Goldring contended that action 5011 was not on all fous with the present one.
