Mr. Hodgson said his Worship would remember that at the last bearing of the case there were two charges, one of behaving in a dis- orderly manner whereby a breach of the peace was likely to occur, and the other charge was one of common assault. One of the male grounds put forward by the de- fendant was with regard to the pass, that he knocked the pass out of the band of the bavildar accidentally. Now, it was very important, that word “accidental," because it got away with the assault and behaviour in a dia orderly manner. He had evidence to put before the Court that before the case came on, defendant had cause to see the Provost Marshal and he told him then, that he knocked it out of the man's band in a fit of temper, which was a different story from what he told in court. That was very important and went to the root of the case and if his Worship could find that Mr.
