The Mar..thon race, which was substkated for the Broke Cross-Country Runs thle year, was held on Saturday afternoon the slakting place was the gate of the Aberdeen docks and up the old Pokfulam Read, past the Dairy Farm, on to Calpe Road nod fiolabed in front of Gov. erament House Instead of the Cricket Ground owing to the advertired balloon ascent, when. F. McBaio The mption was made by Mr. P. Morgan Pail lips, acting on behalf of the plaintiff, and read an follows :-Lokve to appeal to His Majesty in Council that the judgment of the Full Court in this action dated 5th January 19ro be reversed and that judgment, be optered for the plaintiff or a new trial had between the parties. Mr. R. N. Marlend appeared for the defendant.
His Lordship pointed out at the outset that this app'icating would naturally be made to the Full Court, but his learned brother ngreed with him that the application, if going on beyond the Full Court, should be ordinarily taken by the Judge who tried the case, and who knew more about it. It was no use forming a full Court over a formal matter.
My Phillips, in support of the motion, said the only question for determination was that of
čebrity.
Mr. Macleod asked for £500. His Lordship -I suppose there is no doubt that the amount in dispute is over £500'?
Mr. Phillips replied in the negative but sub mitted that a lesser sum than £550 should be. ordered,
His Lordship Seeing that it was a Jury case, it doesn't seem to me lo be anything out of the way.

Mr. Phillips-The matter has also been made vary ansy for Counsel before the Privy Council, and for the Committes by the ex- haustive judgments of the two judka's lin this cafe and it is a matter which I imagine will be disposed of in one day.
The competitors were conveyed to Aberdeen in a launch and arrived at the docks soon after 330 pm, and whenthe roll was called eightcom- petitors did not face the starter. 1 bay wore :— Meuri, Carr, H. Reader Harris, Lt. Brice,. Privates Smith, Cread, Webb, Pallett and Green.
The competitors started off with a hot pace for about a mile and a half up bill and when the top of the active et Fokiulum was reached some of the runners were left a distance behind, Roam and Mills wera kasping well together, accompanying each other almost the whole distance. They steadily increased their lead. On reaching the corner of Castle Road it could be icon that Rosam was fully a hundred yards ahead of Mills, who was followed by Brown and Marsh, with Dyor close behind; the others ware lagging some, distance after the Jeaders Rossm put up good sprint on pening the Garden and won comfortably with bait a minute to spare, from the second mao. The first four mea to hoish and their times were as follows
