Germany.

Herr Schoen, Foreign-Minister, has paid a tribute to Pearce for her loyal adherence: to the Algeciras Act. He also said, in the Reichstag, that Germany had no reason to be disquieted concerning the Angie Russian treaty, as her economic rights were not 'affected.

Royal Amenities. The Emperor and Empress of Germany have arrived at Venice, where they were received by King Victor Emanuel.

The Health of the Prime Minister. The latest bulletin states that Sir Henry Campbell-Bannerman is weak..

Considerable anxiety is felt.

Great Britain and Germany. Prince von Buelow has appealed to the British press to cease imputing anti-British designs in connection with the building up of the German feet; Germany wishes to live in peace and quietness with England, and therefore-feels such imputations bitterly.

Russia.

The Duma hai discussed the Bill for the elevation of the Tokio Legation to an Em- bassy.'

During the discussion M. Ivolsky warmly defended the Russo-Japanese Convention. The elevation was the result of no secret or other obligations, bat of the position attain- ed by Japan. He admitted that the right of Japan to fish in Russian waters, was one of the most serious results. of the Treaty of Portsmouth, but the Convention protected the Russian fisheries against annihilation by poachers,

·ALLEGED BREACH OF

CONTRACT. ON

JUDGMENT AGAINST THE STANDARD OIL COMPANY.

In the Supreme Court, this morning, Sir Francis Piggott (Chief Justice) gave his de- cision in the action brought by Lan Yeong Wood and Lam Choy,' contractors, to recover froin the Standard Oil Company of New York the sum of $70,0:0, being for work done and materials supplied at the request of the Standard Oil Company for their works at Lai- chi-kok, and in the counterclaim for $53,604 for damages.

This case arose out of a contract entered

iqto on the 3rd April, 1905, in which plaintiffs agreed to supply certain materials and do certain work in land re Lai-chi-kok, known as New Kowloon Marine Lot No. 2, of which defendants are lessees. In pursuance of the Contract, plaintiffs provided materials and plant for carrying on the work and did work of the land to the value of $136,689.39. The materials and plant on the work were, on or about the the 28th January, 1907, measured and valued by Mesis. Palmer and Turner, architects, and Mr. Christopher Deswood Thomas, employed. ip the office of Mr. W. Danby was the engineer employed by the defendants to superiutend the work. On the 28th January, 1907, the defen- dants, plaintiffs alleged, prevented them from continuing the work and ejected the plaintiffs, their servants and workmen, (rom the lot and took posiession of all materials and plant be- longing to them upon the lot and have since the 28th January, 1907, refused to permit the plaintiffs to carry out the contract. All this the defendants denied.. They maintained, however, that plaintiffs were out entitled to any payment n the work done by them way im.. properly executed, owing to the insufficiency of workmes employed by them.

The judgment took something like two hours to deliver and covered (wenty-two typewritten folios. The Chief Justice held that the designs provided by the defendants for the plaintiffs to follow were bad, defective and unsuitable, which was the cause of the walls sweeping forward, involving a loss of time. Judgment was entered for the plaintiffs for $50,967.42 and cosis. In the rounter-claim, damages in the sum of Sto was awarded the Standard Oil Company, without costs.
