THE RECENT, SPEECH OF MR. MATSUOKA.

The renewed discussion which is taking place both in Europe and in the Far East concatalog the practice of the infringement of Japandia trade-marks recalls the speeche mads some weeks ago by Mr. Nakamaten, the new Director of the Patent Office, and Mr. Matsuoka, the Minister of Agriculture and Commerce, on the occasion of a dinner given to theofficials of the Department of Agriculture and Commerce and of the Patent Office.

In the course of his speech Mr. Nake matou valdi "There are to cational boun darins la commerce and industry, and in giving protection to industrial property w should never make any distinction between. Japanese subjects and foreigners. We are also bound not to make such distinction by our treaties with the varicus Powers and by the International Convention for the Protection of Industrial Property of which we pre mem bers. But on several occasions, it has been -shown that foreigners are not satisfied with the Japanese administration. We often hear of their their complaints regarding imitation trade-maries by the Japanese in Japan and Chins. But these complaints are partly due

lo a misunderstanding of our intentions on the parts of foreigners. The intention of the Japanese Patent Office is to give protection to the rightfojowcers of industrial property. 11 never makes any distinction between Japan. ese and foreigners, and never gives one treat- meat to one and another treatment to the other. This misunderstanding must be re- moved; and we must do everything in pur power for this purpose for withou removing it commercial and industrial prosperity cannot be hoped for

However shrewd a man may be and whatever capital he may command, if he lacks this quality, he will never -bo-able to male-final success in business. And how Cas a country, the morality of whose traders and manufacturers is of a low standard, expect prosperity ia kei commerce and indue- tries? Among our bodicits me, I am sorry to say, there are 'roine who do not pay sufficient respect to this most in portant principle and who by their dishonest conduct are bringing discredit upon their country, They are acting under'a mistalen notion that as the object of commercial and industrin activities is to make profits, any means to achieve this object are legitimate whether they be fair or foul. Thus they do not besitate to imitate forsign products, or to steal foreign trade-marks. Such unscrupulous conduct must be strictly prohibited, and measures must be taken to promote the credit of our business men. The business of the Patent Office has a close connection with the subject; especially in the prosection of trade-marks. In the discharge of their duties the officials of the Patent Office masti therefore, act most carefully and impartially and, not content with the mere, wording of the law, they must enter into its spirit of giving protection to rightful owners. It will ant do to accept an application' merely on the ground that it is not against the law, but they must also be convinced of the perfect propriety of the ap-- plication. For there may be among many ap. plicants some who, devoid of all moral sense, at- "tempt to pázs through the meshes of the network of the law, if such applicants be encouraged the interests of rightful owners will be endan- gered contrary to the spirit of the law, and business morality, instead of being raised, will ba lowered. For example, bere is a well- established foreign trade mark, and suppose a person taking advantage of the mark not being registered in Japan, has applied for its registra tion in his own name. In such a case, it is my opinion that the application should not be accepted. If the fact cannot be ascertained, it cannot be helped; but with due diligence such dishonesty can in many cases be detected. Since the late war the standing of Japan among the Powers has bee, greatly raised, and the world keeps a keen eye upon all our Rctions. It is now bigh time to take measures to raise the moral standard of our business
