No, gentle reader, you are (as usol) mis- taken. The object of this screed is not to en- courage a series of frau is upon excellent trades men. That would be, without doubt, contraryGermary-Bank T.T. nu. to good morals, and public policy. Noj my wholly innocent object is to suggest that the law, in an important particular, needs amend
ment.
Married women are now the spoiled children of English law--not, of course, in all respects, but in some. It was not always so. För a Song time the taxi-books trested questions relating to married, women midway between questions relating to infants and quesitons rolailng to lunatics. The ladies shared the disabilities of each of the other two classes. But then came the rough-so-rady, hand of «legislation, until now a series of Married Wo- men's Property Acis. have placed wives and mothers in sogreatly favoured a position—Again, in some respects that it is almost dangerous to do business with them,
4
THE BLAMELESS TRADESMAN. . ́* The general question is matter for a separate, treatise. But I want to call attention to the strange case of debts incurred by married wo- men. To put the matter, shortly, and Ignore- -unimportant, exceptions, one may say that nowadays a' married woman” and her husband are, in a financial sense, airangers. The huf- band cannot dispose of his wife's property, nor the wife of her husband's property. When she makes a contract, the presumption is that the is m-king-it on her own." But she can still, to a limited extent, pledge the credit of her husband. How in the blaneless tradesman to know whether in fact she is doing so or not?
Obviously, he cannot ask her. If he did, he would soon hava no customers to mik. So he is left to the operation of the law, which some. times moves in a mysterious" way. Tüke the simplest, and commonest, case of a married woman, who is living, with her husband, The question whether she can pledge his credit is purely a question of the law of agency. The fact that she happens to be his wife is apparently immaterial. It she is acting as his agent to buy, he is liable; other wise not. Now, of course, no difficulty arces where a wife has "express * authority to pledge bar husband's credit. But, in the absence of such authority (and such authority is not com mon) the difficult question arises whether au- thority is "implied.".
A long series of decisions-I need mention only "Debenham v. Mellon," "Jolly v. Reas," *Seaton v. Benedict," "Montagio v. Benedict," and "Manby v Scott"-his left the law in ri clear but unsatisfactory condition. There is a presumption that a wife living with her hus band has his authority to pledge his credit for necessaries "that' to say, not merely for the bare necessities of life but for all articles reasonably necessary for the manner and station in which, the household” five. "seems fair and reasonable enough.

The difficulty is that "by various ways the presumption may be rebutted, and therefore it may prove the merest pifall for the unhappy tradesman who relies upon it. I think," said Lord Blackburn.in the case of " Debenh;m v Sept., Haiphong 25th, "epi., and Hoihow

If the husband can-make good any one of these four allegations of fact, the presumption is gone and the unfortunate seller may whistle for dis money,
A CHOICE OF EVILS. Now, in this quite fair? Of course, it is fair enough that the tradesman should not be able to recover if the husband has given him clear notice beforehand that he refuses to be held liable. But what is to be said of the other three cases) How is it to be known, 'ör 28- certained, whether, the elegant lady on the. public side of the conger has a sufficient a'low- ance, or not? How is it to be known, or as- certained, whether she has a sufficient supply, ...or not?. Above all,' how can anyone be ex- I pocied to know, whether the prudent husband, ©in the cmall hours of the morning,'when there' was nobody in the bedroom but his wife and self, forbade the sharer of his joys in pledge this credit) Yet a probibition of that kind is,
