Fadia T.T... injuride brought by Humita Loujša Marguerite
Do. deinaed Stamirowski Against Mme Madeline Barber, Shanghai-Rank TT. the owner of a "variety" act known as "Loop | Singapore T.T. ing the Loop,"
Japan-Bank T.T. Java-link T.T.
Mus Stamirowski, who is 20 years of age, used to dance at the Alhambın, 'Later the
joined a troupe of tick cyclists, and finally she contracted with Mme Barber in "loop the loup."
At her incond wrtempt, at a munc-ball in Sunderland, where two performances nightly are given, she fell from the summit of the loop and fractured her skull, For six weeks she lay in hospital in up' unconscious condition, and for some time after she recovered her senses she was bld.
"SENSATION OF THE CENTURY." According to an illustrated handbill which was used to advertise it, the young lady's pers formance was the "sentation of the century," and "the most costy and gigantic act ever produced upon any singe?" "But she had no experience of looping the loop" until she was engaged by Mine. Barber.
According to Mr. Le Breton, K.C., who re presented the plaintiff, the performance differed, mater ally from that of the famous "Diavolo,”' the plaintiff's predecear. Whereas "Diavolo's" navigation of the "lop" trqued a great amount of nerve and skill, the feat of Mile.
Staniowski was supped require neither
of these atributes.
Her bicycle, counsel explaine-1, was not an ordinaty, machine, but onn' supplied with a variety of ingenious contrivances in ensure that it should not jump from the track, including. alight, but strong, projecting arms from beneath | the handle-bars and the hub of the rear wheel, the end of which curved over on 1s the run of the "loop" and ran na rubber wheels, More- over, the performer was secured to the bicycle by means of an arrangement concealeil in the folls of her sash,
"THE WRETCHED SUM OF JO, WERKLY!"
For performing her sensational feat twice a 'night, the young buly was to have received as remuneration what the judge described as "the wretched sum of jos, weekly," and on her behalf a contract was signed, freeing her em. ployer from all responsibilities in respres of her "turn"
The plaintiff's contentiam was that Xime. Barber had been gushy of negligence in per- muting the pie insecure, the bicycle unfit to be rdden, and the sach and "set hoak" totally unstable. Counsel observed, more ver, that no adequais uet was provided in connection with the performance.
The Judge: I suppose the puble would not have attended if they were quite certain the performer would not be killed. (Laughter.)
Mr. H. Simmonds (for the delendal) Dal you not wobble and ny to release yourself when you reached the top of the loop? -, 1 heard a "click," and the machine commenced to run backwauls. I thought it wild nun fürs ward again, but it left the fack, and. 1 fell on the sises the bicycleáalking nà toți ul Hus
NOT THE HICYCLE SHE RUDE. Mile, Stamirowski explained that before she negotiisted the "loop" an ordinary bicycle was produced in the stage, but it was not the one the rode.

Mr. Simmonds: Would you object to go round the loop now?-1 would not, hat my leg won't let me. My heart is good. (Loud laughter.)
The witness admitted, amid further metri. ments, that the production of an ordinary bicycle on the stage previous to the introduction of Mlle. Samirowski was mere "bluff.*

possible that such a case as the one before Beaumont, Mr. and Mrs. H. S. H. Baird Kiangloo...
them might lead to an alteration in ht law.
**This is a highly civilised country-the Judge added-more highly civilised, we are proud in think, than any other country. We do not allow bull fights,
OUR REGARD FOR BULLS AND HORSES. "No one is allowed in endanger the life of bull or an old horse for public entertainment, but, being far more civilised than any other country, we do allow girls to 'loop the loop
perform tricks of that kind, and it does occasionally occur that they fracture their sulla.
We are told that this is really a necessary part of this engaging profession, the sort of thing that happens through no ane's neglence, but is just part of the ordinary risk that girls in this country are allowed voluntarily to incur." Turning to the position of the defendant, his lordship said that, as a public entertainer, i she neglected to take proper prections, and as a result one of her performers was burt, she. became respons ble civilly.
"And I think I ought to say," the judge con cluded, "that if people allow this kind of risky entertainment and do not take proper precau tions, they become responsible criminale if Rayone dies."
£250 DAMAGLE.
The jury awarded the plaintiff £150, and re- commended that, if possible, an order should be made for its investment by trustees for her boneffi.
His lordship held that the agreement signed by the plaintiff did ant disentitle her from re: covering the sum awarded by the jury. Ha Added that even if the agreement had been catered into by a grown up person he would have decided against it on the ground of "public policy."
