Mr. Oito King Sing was to have appeared for plaintiff, whilst Mr. P. W. Goldring for the defence.

After keeping the Court waiting for nearly twenty minutes it was announced that the case had been settled although the Court had not been notified.

His Lordship struck the case out of the list.

LEAVING WITHOUT NOTICE.

At the Supreme Court this morning, before the Puisne Judge (Mr. T. Sercombe Smith), Pun Fung Sang sued Tsun Fung Wing, for the recovery of $145, money alleged to be dus for rent in lieu of notice in respect of premises 115, Jervois Street.

Mr. Barlow appeared for the plaintiff, and Mr. F. X. d'Almada e Castro for the defence.

Plaintiff stated that defendant took the house in question in the middle of the third month. on a monthly tenancy. He paid three months' rent but left in the middle of the sixth month without paying the usual month's rent in lieu of notice. Defendant wanted to rent the place. for two or three months but he said he could not let him have it on those terms, and the least he would let the place for would be five) or six months. He did not demur and later

paid plaintiff three months' rent. Defendant afterwards offered to pay half a month's rent

In lieu of notice, but he refused,

For the defence it was urged that the tenancy was for three months only, and two witnesses were called in support of the contention,

A partner in the defendant's business was called and said that the premises where they did business before going to Jervois Street, viz., in Queen's Road Central, were destroyed by fire. The landlord, however, said they would be rebuilt and again let to them in three months. That was why the premises were only taken for three months. They did not, however, go back to the old premises, as the landlord insisted on raising the rent prohibi- tively.

In the end, His Lordship found for the defendant with costs.
