Great Britain is Chil-bound by all existing tenancies and rights in the soil and can neither dispossess the present holders nor vary the terms of their holdings until the existing tenancies are at an end. It is specially stipulated in the Convention that there shall be no expropria tion or expulsion of the inhabitants and that any land required for public purposes must be bought and paid for at a fair price. All Chinese land is held of the Government of China on perpetual lease at fixed rates of rent, and no Government in China has ever dared to raise the rents once fixed. When the new territory passed to us under lease, the inhabitants became our tenants of their holdings upon the terms and at the rents at A. S. WATSON & CO., which they held them from the Chinese Co. vernment, and upon no others. There is no more power in the Colonial Government ur in Her Majesty the Queen to vary the terms of their holdings or to demand in or expropriate their lands. Taxes may be imposed and enforced, but the terms of which the Chinese inhabitants, now hold the lands can in no way be altered, either by legislation, or by the will of the Governor. To attempt to do so is to attempt a fraud. The Government has no right or power to collect any rents from any lands, whether argicultural or otherwise, than those hitherto paid to the Chinese Government for the same lands, and no order in Council or Ordinance can give the Governor, power 10 do.50.
