As to the Ordinance counsel said there was considerable carelessness la it and perhaps want of, knowledge. Counsel then quoted a number of English judgments all relating to the discretion of judges which he said showed perfectly clear the duty imposed on the defendant.—It was -distinely-s-power to do jedicial act but not an administrative act The daly of paying the compensation was with kim and he had to exercise his judicial diacreiles on the fac:s before hirs.

After further argument the case was adjourned till to-morrow at 10'30 m.
