It is not alleged in this case that the separation was by mutual consent, but it is maintained that the separation was due to the husband's misconduct, and the misconduct that is alleged is desertion on his part. Luch's Law of Fusband and Wife p. 330 says what. amounts to desertion so as to raise the agency of necessity does not seem to have been actually laid down. It is conceived that any leaving of of the wife without a mutual agreement would be sufficient to create the agency of necessity, unless it was her own misconduct that occasioned the separation. BOMBAY, Joly 6th., This morning at the Marine Court of Enquiry Mr. Rivett-Carosc appeared for Captain Bennett, of the steamship Ajmare, which was wrecked last month, and stating that the Captain was {}! la hospt:al, produced a certificate of his inability to attend Court. The Government Selicitor then cited authorities to show that the Court mast give its decision openly, when Mr. Rivett Camac placed on the record his objection to the Court's Jurisdiction, and at once visited his client in hospital for instructions as to the charges of reckless navigation. Return ing to Court, Mr. Rivett-Carnac aald that the Captats admitted having relied upon abser vations taken a noon on the 14th of June, and did not deem I necessary to take soundings. The President of the Court then gave his, decision, adjudging Captain Bennett guilty of reckless navigation, and of having refused to take soundings, although recommended to do so by the 1st and and officers. The Court was of what less than ten fathoms of water for, no oplulon that the ship must have been in some hours, preceding the disaster. The caplain's certificate which had been lost with the ship's papers has been suspended for twelve months. but to consideration of the energy he displayed la saving the lives of the passengers and crew, the Court has recommended that he be granted
