Mr. Philippo :Yes.
In reply to his lordship, Mr. Ellis said he was instruried to accept the $800, with costs. In full satisfaction, and he would have notified the other side accordingly, but found he could not get the money out of court on account of the condition attached, which made the payment lato court of no use. The Marinturk Co, did not admit the counter-claim for $973,45, nor any of it.
Mr. Phillippo said he would consent to judg- ment for $800 without costs.
His lordship: Why not costs?
Mr. Philippo said that the 38co offered' was more than was due and was simply fixed at that Agure to cover any costs there might be. It was paid in for the sake of peace and quietness, and if the Marinbek Company would take it, well and good; if they asked for more, then Scheele and Company would fight the case.
Mr. Ellis pressed for costs in addition to the $80. What he wanted to know was whether the Boo was paid into court or set on the claims, costs being another matter entirely.
