Prisoner Breaks Down After Being Calm

UNUSUAL KNIFE USED IN MURDER

Leung Kam. the murderer af lp Wah, the young vegetable hawker, at Po Tol Island, on June 26 last, is to expirate his crime on the gallows. After a trial lasting a day and a ball. the jury yesterday afternoon brought in a verdict of guilty and his Lordship passed sentence of death.

Leung Kam received the jury's verdict in the same calm manner which he had displayed throughout the trial, but after the words of the judge "You will be taken bence to the place ence you came and thereafter be hanged by the neck are dead. And may the Lord have mercy on your soul,"

Just before pronounced Leung am had again maintained his innocence. Asked If he had anything to say, he re- plied: "I am innocent."

In his evidence yesterday Leung Kam said he had gone to bed at 9 p.m. on the night of the murder. His wife and his two sons slept with him in the boat. After he had been asleep for some time he was awakened by a man ramed Tal Ung Chai, and asked whether he had killed anybody. Tai said it had been alleged that he (laung) had killed someone. Leung re- plied that he had not killed any body. Later Leung. Wat Sing shouted to him. He said. "Af Kum, have you killed anybody?" Witness eald he again answered in the negative. Later he went to the police station and made a report.

Cross-examining.

Mr. Whyatt

asked Leung Kam; Can you suggest any reason why Ip Ping Cue should make these false accusations against you?

Leung Kam replied: I do not know why he should do so.

Mt. Whyatt: You have known each other for five or six years?—Yes. And you had been on friendly terms? Yes.

Evidence was given by Leung Kam's wife and his son. Both said they had slept in the boat with their father on the night of the

murder. They went to bed about 9 p.m. and did not awake until the next morning. They had not seen their father-leave the boat after they had gone to bed. If he had left the boat they were sure to have seen him.

In his address to the Jury Mr. D. J. N. Anderson, for the defence. urged that if there was the sligh- test doubt in their minds as to the identity of the murderer they must give the benefit of that doubt to the accused.

During a lengthy summing up his Lordship said there" was no reason, on the evidence, to believe that this was a case of mistaken identity. Indeed, even the accused did not suggest it was a case of mistaken identity. His story was that it was a conspiracy to do him

a wrong.

Finally, his Lordship, on behalf of the accused, drew attention to the fact that the crime had beer. committed with an unusual sort of knife-one with a triangular shaped blade and it had to be borne in mind that no one had come forward to say that the ac- cused ever possessed such a knife. That, his Lordship. said. was an unusual feature of the case.

After retiring for about a quar- ter of an hour the jury returned with a unanimous verdict of guilty "and sentence of death was passed.
