U.S. COURT.
JUSTIFICATION FOR BIGAMY,
Phenix, Arizona, - December, 15.- - leading that a prisen sentence apowed upon hini following his conviction on charges of bigamy be easide Dr. Allan Alexander Stirling to-day appeared before the Arizona supreme court. He asked that the entenes be set asido se that he may claim au carldom which he has inherited. Dr. Stirling read his claims to having inherited the earldom before the court.
י
According to Dr. Stirling the 10th Earl of the catate he is claiming died in England in 1928. He said that the Ear-Jaff will required that his heirs marry within a year
be disinherited.
So Dr. Stirling promptly pro coded to marry Miss Elsa Worch of Sunburst, Montana. Later they. soparated and he married Miss Virginia Hovater, a resident of Arizona. Dr. Stirling now claims that his first wife had been pre viously married nfl hnd not bother ed to obtain a diybreo when showed. him. Hence, 4 claimel, his Montan marriage was automatically vioded and hy ie not a bigamist.
Some Confusing Claims. Dr. Stirling e a former officer qu the staff of General Pancho Villa, the famed Mexican revolutionary leader. In court to-day he found himself in some difficulty in giving testimony as to his claim to the English carldom. Ho said that the 13
Earl of the line he claims was Viscount Canada. Then, under. examination, he admitted that the earldom he claims was abolished in 750, A.D. But, said the witness, it was restored to years later.
Under subsequent examination Dr. Stirling testified that his grandfather and not his father waS an Earl. He claimed thing the en- tire estate had been-bequeathed to him.
Dr. Stirling's father, he claimed, came to the United States during America'a civil war. Later, he said, he went to New Zealand as a physician I was born aboard ship en route to New Zealand," Dr. Stirling told the court to-day. “I also am a physician.'
As the evidence progressed, the court and newspaper- soporters be- gan to become almost as confused as the witness. They hope, some time, to learn just what English estate Dr. Stirling is claiming.
