FURTHER EVIDENCE IN OPIUM CASE.

WHO BROUGHT THE LUGGAGE?

The case in which Mur Kwok Leanga Justice of the Pence of Singapore, is charged with posses sion of opium, was continued at Central Magistracy yesterday be fore Mr. R. E. Lindsell.

Mr. J. D. Lloyd, Superintendent of the Import and Export Office, prosecuted, and Mr. D) L. Strellett was for the defence.

At a previous hearing Mr. Lloyd had" given evidence concerning in- structions to officers of the Revenue Department. He continued his evidence yesterday, when Mr. Strellett put a series of questions to him regarding the discretion to arrest given to Revenue Officers.

Mr. Strellett asked Mr. Lloyd if the latter agreed that since the amendment of the Opium Ordin- ance; the onus was not on the prosecution to prove that a person had knowledge of the contenta of any baggage or luggage which he carried, but rather on the defence to prove that there was no know- ledge of the contents of such bag- gage or luggage. Mr Lloyd agreed.

Mr. Strellett: In view of this section, can you state any reason why the Revenue, Officers did not intercept the person who brought the opium into the Hotel 7--The in- former did not know that the opium "was going into the Hotel, "but he know it was coming out.

Mr. Streilett: We have heard in evidence that C.RO.. 9 knew that the opium was going into the Hotel?

'Not Relevant?

At this point, Mr. Lindsell said that it seemed hard for him to see the relevancy of the question. He did not see that the prosecution was called unon to answer such a ques tion. The Magistrate asked 3. Strellett what relevancy had such a point to the charge

Mr. Strellett replied that he wanted to know why, if the men who brought the opium into the Hotel could be arrested, were they not arrested since the presence of these people would be of extreme value in 12 case of the present kinil

Mr. Lindsell pointed out to Mr. Strellett that the onus was not on. the proscention, but on the defend. ant to satisfy the Court that he had no knowledge that the opium was there.

Mr. Strellett, in reply, asked how was it possible to prove that with- out the presence of the person who brought the opiuma. He pointed out that if a persor put opium in his (Mr. Strellett's) pockets. while he was on the strect, and an officer witnessed the net and chose, to ignore the person who placed the opium in Mr. Strellett's pocket, preferring to take action against Mr. Strellett, the latter would be rather handicapped.

Mr. Lindsell then asked why the questions which Mr. Strellett was putting to Mr. Lloyd were not put to the Chinese Revenue Oficer when the latter gave evidence. He thought Mr. Strellett should have naked that man why he did not intercept the opium before it reach ed the hotel.

that the hotel employees could not give any description of the four coolies whe brought the luggage to the hotel.

Answering another question, Mr. Lloyd stated that he had heard that two men went to the hotel with the baggage but was not sure on that point..

In regard to the value of the opium, Mr. Lloyd stated that the 1,184 taels of Red Lion" brand of opium would cost about $4 a taci or roughly about $1,700. An To gards the 1,359 taels of raw Persian opium, Mr. Lloyd said that be bad no idea as to the market price of; this, but thought it would be a little more than $3 a tael. He agreed with Mr. Strellett that the parcel would cost more than $0,000. A room boy in the Empress Hotel was next called. He said that on the morning of March 1 he roused the defendant at 0.30 a.m. The de- fendant left the hotel at about 7 a.m., to go on board ship" but returned later, stating that he want. ed to find his keys.

Cross-examined by Mr. Strellett, witness said that the defendant ar rived at the Hotel on February 27 with two large cases and a smaller and. The day following his arrival, witness had seen a man in European elothes emerge from defendant's. roon. Another person, a youth of 10 to 15 years of age, was also seen in defendant's room: On the norning of the defendant's arrest, the man. and the boy was seen coming out of defendant's room again. They arrived separately and left separately. The defendant re- turned a second time on the morn ing of March 1, being accompanied by a constable on the second oc cnsion. He had then consulted telephone directory.

Tang Kam, the youth who was earrying some of the luggage when the defendant was arrested, was, next called. Ho stated under cross- examination, that he had on previous

Occasions looked after the defend ant's luggage when the latter left- Hong Kong. The witness related an instance when Revenue men de- manded to search same ten suitcases belonging to defendant and, in spite of the latter's process, the luggage was searched, but nothing was found. On another occasion. the defendant's wife was sailing for Singapore when the Revenue men wanted to search the luggage. De- fendant pointed out that he was a J.P. of Singapore and produced a just the same, nothing being found. card, but the luggage was searched

The hearing was adjourned.
