TO ONE YEAR'S IMPRISONMEN His Honour Judge Charles. S. Lobingi, in the U.S. Court for China at Shanghai Last week, sentenced Edwin G. Hinde- whose trial recently took plaès on two charges of embezzlement to one year's imprisonment in Billibid Prison, Manila
The judgment was as follows— These are informations charging defen: dant with embezzlement of the sums of Tls. 3,000 and Tis 2.810. Defendant ad- nitted having received said suns from complainant with instructions, he states, The invest them, as he saw fit." complaining witness, on the other band, testified that these two sums represented salary received and due to her as `a teacher in the French Municipal School; that upon defendant's advice she trans- ferred the larger su to the International Banking Corporation from another bank and left instructions for the salary doc to be deposited in the same institution; that on June 18th, 1993. she gave defen- dant two black cheques, duly signed, for the purpose of transferring these funds from the tael account to a gold account in the said bank, the purpose being to enable him to take advantage of any favourable turn in exchange after her. departure for America, which took two days later. The defendant, however, RUSSO-ASIATIC BANK. used them for the purpose of withdraw- ing the funds entirely from that bank nod depositing them in another to the credit of Hinde Bros. and Co. (unincor- porated). The money has never been repaid the complaining witness and de- fendant admitted his inability to repay.
We do not overlook the fact that the relation between the parties was some- thing more than friendship. Bat we think the evidence wholly fails to show that they were engaged. On the contrary a letter (Exhibit 1) written after her departure clearly tells Mefendant that they were not.

Nor is this case" where one of the parties might have been mistaken. We can see no reason why the complaining witness should attempt to fasten this charge falsely upon one whom she had concededly regarded in the light of a suitor. Defendant's interest in establish- ing a different arrangement was obvious, and considering this interest as well as the corroborating circumstances, we must had that complainant has established her claim beyond a reasonable doubt.
