At the Magistracy, yesterday, be tore Mr. N. L. Smith, the hearing was concluded of the case in which the manager of the Great Eastern Hotel was charged with allowing his premises to be used for immoral purposes.

Mr. Eldon Potter (instructed by Mr. H. L. Denny) appeared for the defence.

The case for the prosecution was that certain Europeans engaged rooms at the hotel on different dates and stayed there with a Chinese girl, a prostitute who is now undergoing a term of one 'month's imprisonment for soliciting. Their alle gation was that the management had guilty knowledge.

Mr. Potter, for the defence, said that | it had not been proved that the defendant bad guilty knowledge. The prosecution witnesses went so far as to atnte that they had not seen the defendant at the time the room was engaged. The girl had not seen hit, nor had any of the other wit- nesses. Whether the manager had been pegligent was another matter. The only paint the Crown had proved was knowledge of the room-boy.. Assum ing that the boy knew that the woman was a prostitute and bad come there for an immoral purpose, that in itself was not sufficient to prove that the defendant had guilty knowledge.

Mr. Smith suggested that the room-boy might have had delegated authority.

Mr. Potter replied that there was no evidence of that at all.

Mr. Smith: There is no evidence as to how a room is engaged at a hotel. You walk in, sign your name and pay.

Br. Potter renlied that they could not judge a Chinese hotel from the anme point of view as a European. The Magistrate would hear that, far from the room-boy- baving any authority for permitting & room to be used for the purpose, he bad definite instructions not to allow rooms to be given for immoral purposes. The case was one of extreme gravity as far the defendant was concerned by reason of the maximum penalty being a fine of $1,000 or six months' imprison- ment. There was also the danger, if the

was found guilty, of the hotel licence being jeopardised. When he told the

Magistrate that the capital sunk in. the hotel was over $100,000, which had been actually expended, the Magistrate would realise that it was a very serious matter indeed, and it would show the Bagistrate whether defendant was going to permit the improper use of his pre- mises for a paltry sum of $3,75

HONGKONG MAGISTRACY, AMMUNITION SMUGGLING.

A Chinese was charged before Mr. N. Smith, yesterday, with being in an- lawful possession of two daggers, parts ofia revolver and several bundred rounds of ammunition.

Defendant stated that he had only Lately arrived from America. His brother was dead and, he brought his brother's effects to take to his brother's widow in the country. He was unaware that the boxes contained contraband.

The police said the contraband Was concealed in a box specially made with a secret compartment,

COUNTERFEIT COINS.

A Chinese was charged with being in unlawful possession of 781 counterfeit ten-cent pieces, Hongkong currency, 107 twenty-cent pieces and 23 ten-cent pieces

Chinese currency.

Defendant's excuse was that a man engaged him to carry the bag, promising bim $3.

Mr. Smith sentenced defendant to six months' hard labour on the first charge, and to a fine of $500 on the second.

EXPORTING SILVER.

A Chinese was charged with attempting to export subsidiary coins to the value of 850..?

Defendant stated that a clansman gave him the coins to take to the country.

Mr. Smith ordered the money to bo' confiscated.

A. Chinese was charged with returning from banishment.

Defendant had been convicted for shatching and after serving a term of twelve months hard labour, had been banished for five years in 1915. The man pleaded that he was under the impres sion that his time had expired...
