CHARGE AGAINST BRITISH CAPTAIN

ALLEGED UNLAWFUL IMPORTATION OF OPTUM.

At the Police Court, Shanghai, on the 21st inst., before Mr. G. W. King, Police Magistrate, the case of Her (Chinese Maritimo Customs). D. Maclean, E. Barry, and R. Hayes was heard. The defendants, D. Maclean, Master of the Blue Funnel str. Neleus, E. Barry, chief steward, and B. Hayes, lamp-trimmer, were charged in connection with the alleged unlawful importation of opium.

Captain Maclean was charged for that he, on July 22, at Shanghai, did present a false manifest of the cargo carried on board the steamer Veleus to the Chines: Maritime Customs by omitting to declare therein certain tins and packages of Persian and prepared opium of the weight of 450 lb. or thereabouts (valued at Hk. Tls. 19,000) carried in the said sicamer, contrary to the provisions of article 37 of the Treaty of Tientsin.

THE SLUMP IN JAPANESE AND

COTTON GOODS.

The bottom has fallen out of the yarn market, and the Osaka yarn exchange. closed in a panic last week. A proposal for relief measures is on foot, having been initiated by the Japan Yarn Merchants' Association, seconded by the associated yarn exporters. It is maintained that the slump is not due to over production, but to the war, which has caused the silver market in London to close, this resulting in turn in the dislocation of the China exchange and the refusal of banks to accept drafts for Tsingtao, Tientsin, and Hongkong. Drafts an accepted for Shanghai, but at the exorbitant rate of 2 per cent, at which no business is being done. It is, therefore, a shortage of money which is responsible for the slump in yarn, and the need of the moment is to remove this cause. Most of the yarn exporters are in favour of asking the Government for financial assistance, and E. Barry and R. Hayes were charged it is believed that this will be the course for that they, on July 21st, did import or attempt to import into Shanghai market advanced by about Y5 in view of adopted. Mr. Oppe said the charges against Barry and Hayes were similar, and he proposed that they be heard first.

His Worship agreed, and observed that possibly the case against the Master might go further than that Court.

Mr. Sebastian said that both Hayes and Barry wished to be tried summarily.

His Worship pointed out that the maximum sentence was six months hard labour and a fine of £100.. In that Court, he could not go beyond three months, or a fine of £20.

Mr. Oppe said he would not press for anything more than his Worship had jurisdiction to give. He desired that the cases be tried summarily.

Mr. Oppe having opened the ease for the prosecution,

W. Nash, first-class tidewalter in the Chinese Customs, was called, and said that acting under orders he boarded the atr. Veleus on her arrival in Shanghai, and placed six officers at different parts of the upper deck to prevent anything from being passed over the side.

the remainder of the party he searched the firemen's quarters and then the engine room. After searching for two hours, he was called to the engine-room and was told that one of the European crew wanted to see hin. This person, was the lamp-trimmer, who informed witne that he had some opium in his room and also in the lamp-room. He went to these two places and seized from a locker under his bunk one bag containing six packages of Persian opium, and from lockers in the lamp-room twelve packages of Persian opium. The lamp-trimmer informed witness that the parcels had been given to him by the No. 1 fireman at or before reaching Port Swettenham. The No. 1 fireman was discharged at Hongkong and the lamp trimmer was to keep the parcels until called for at Shanghai. Atter leaving the lamp-room witness went to the saloon, where the chief steward asked him if he was looking. for "dope." He answered "yes," and asked whether he had any. He said he had some stuff ju his bonded store room which he had better come and look at. Witness went to his store-room and seized four bags containing prepared and raw opium and fifteen tins of prepared opium. The steward said. the above had been given to him by the No. 1 Breman at or before reaching Port Swettenham to be placed in his bonded store-room. The bunkers were afterwards searched and one package containing thirty-three tins of prepared opium was found in the port bunker. This package had evidently been thrown down the bunker from on deck during the search, as evidence of this was shown by some of the tins being smashed and traces of the opium had leaked out on the plates. The vessel was thoroughly searched, including all officers' rooms, from 7.40 p.m. to 6 At 7 am. witness telephoned to Mr. Dawson. chief tidesurveyor, the result of the search and also that the person who had given information was on board. Witness received orders to ask the Captain if he would allow the arrest of this person, and if not he would be held responsible for his detention until a warrant for arrest was obtained. The Captain agreed, and the River Police took the man into custody.

C. Halloran, third-class tidewaiter, and A. Schmidt, Deputy Commissioner of Customs at Shanghai (on whose complaint the charges were laid) also gave evidence, ease for the and this closed the prosecution..

The hearing was continued in the afternoon, the case for the defence being that the defendants had acted bonâ fide all through. The packages were received from the No. 1 fireman, and defendants did not know what they conlaired. When they discovered the opium, they' disclosed it before they knew that the Customs officers were on board.

Connsel addressed the Court, and his Worship reserved his decision until today.
