Some years ago the Nippon Ynson Kishin established lins of steamers to European ports, passing West of the Suez Caust, and taking part. not the trade to Japan, but in the trade between Toukia Provinces Quinhon Great Britain and hor Colonies; their right to thus compete against the European lines, which up to that time had supplied the route with Manila tonnage, was never questioned, and the best

"SQUELAED BY MONEY-LENDERS "

LORD CHIEF JUSTICE AND A BORROWER,

Some very strong remarks on the practices of some money louders were made on Aug. Sib by the Lord hief Justice in anucaucing his decision in a money.lending case.

money-lender named Burgess sued a clerk named Fibs for a balanca on a lebt. The facts as stated by the Lord Chief Justice were that Mr. Ellis barrowed £1 for the purpose of taking his invalid wife abroad, expecting that he would receive the money from his employers. He did not get it, however, and he got into difficulties about the payments, and was formed to borrow

muru money.

When he had repaid £157. 58, and there was a balanes of £120, Mr. Ellis gave a promissory note for £100 to secure this, and a few days later be was sent for again and told that there had been miscalculation, and that he must gise uncther pots for £21. Be had no choice

to do this,

The Lord Chief Justice prefacut his remarks by saying that he had o prejudice against money-leaders, but regarded them as necessary, and he did not even go so far as to agree with those who called then a necessary evil. It was quite clear in this case, he said, that Mr. Ellis had no real security uzcept that he was in a good situation, and the fact-well known to moneylenderethat very often if a man were bonest he would make extraordinary efforts to repay

I have

no doubt," said the Lord Chief Justice, that these money-leaders snou found out that they had a porforuly honest man to deal with, and a man who could be synozed, and they uvailed

of that knowledge to pat these cas vary in their own pockets," Referring to the note for £21, the Lord Chief' „Jastions said :-- Could any oue imagine mor unjust and inequitable proposition roming from any firm of money-leaders? The dat was not that there had been a miscalcula ion

a

in regard to the settlement but that they found that Shoy had could

gut a man out of whom they squeeze a lot more."

the

The

Lord

Chief Justio added that he entitled recoguised that money-leaders were to a abigh rate of interest, and he ruled that the interest should be calculated at 25 per cent. He directed that an account should be taken on this basis, and that all sums paid in excess of this should be refunded to Mr. Ellis. He also dimoted that the costs of the action should be paid by the money lenders
